AMENDMENT TO SENATE BILL 262

AMENDMENT NO. ______. Amend Senate Bill 262 as follows:

on page 86, by replacing lines 3 through 5 with the following:

"(f) Non-construction solicitations that include Business Enterprise Program participation goals shall require bidders and offerors to include utilization plans. Utilization plans are due"; and

by replacing line 19 on page 111 through line 3 on page 112 with the following:

"(b) The Department of Central Management Services shall provide a report to the Council identifying all State agency non-construction awards that exceed $20,000,000. The report shall contain the following: (i) the name of the awardee; (ii) the total bid amount; (iii) the established Business Enterprise Program goal; (iv) the dollar amount and percentage of participation by businesses owned by minorities, women, and persons with disabilities; and (v) the names of the certified firms identified in the utilization plan."; and

on page 114, line 13, by replacing "shall" with "may"; and

on page 115, line 2, by replacing "diversity" with "contract"; and

on page 115, line 10, by replacing "diversity" with "contract"; and

on page 115, line 13, by replacing "prime contractors" with "a prime contractor"; and

on page 115, line 15, by replacing "diversity" with "contract"; and

on page 115, line 16, by replacing "(e)" with "(d)"; and

on page 115, line 19, by replacing "diversity" with "contract".
