SYNOPSIS AS INTRODUCED:
 
735 ILCS 5/2-201.5 new

    Amends the Code of Civil Procedure. Provides that a summons issued in an action to collect a debt shall include a separate notice containing specified language regarding debtor rights. Provides that the clerk of the court shall cause the notice to be posted in courtrooms or in the hallway in front of courtrooms and be available for distribution in all courtrooms hearing cases involving debt collection matters. Effective immediately.

1    AN ACT concerning civil law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Code of Civil Procedure is amended by adding
5Section 2-201.5 as follows:
 
6    (735 ILCS 5/2-201.5 new)
7    Sec. 2-201.5. Debtor notice.
8    (a) A summons issued in an action to collect a debt shall
9include a separate notice containing the following language
10printed prominently in large font:
11    "IF YOU OWE A DEBT, YOU HAVE RIGHTS
12    You Can PROTECT:
13        Your Social Security
14        Your SSI
15        Your Public Benefits
16        Your Veterans Benefits
17        Your Retirement Benefits
18        Equity in a Motor Vehicle
19        Equity in your Home
20        Your Bank Account
21    You Can STOP:
22        Phone Calls from Creditors
23        Verbal Abuse from Creditors

1        Threats from Creditors
2    You Have the RIGHT:
3        To Privacy
4        To Have the Court Review Any Agreement to Settle Your
5        Case
6        To Ask for a Reasonable Payment Plan".
7    (b) The notice in subsection (a) shall include the dollar
8amount of the statutory exemptions for vehicles, homes, and
9bank accounts and shall prominently list the name, address, and
10phone number of at least one legal aid provider located in the
11same county as the issuing court.
12    (c) The clerk of the court shall cause the notice in
13subsection (a) to be posted in courtrooms or in the hallway in
14front of courtrooms and be available for distribution in all
15courtrooms hearing cases involving debt collection matters.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.
