SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/21B-40

    Amends the Educator Licensure Article of the School Code. Provides that, beginning July 1, 2018, a licensee who holds a paraprofessional educator endorsement on an Educator License with Stipulations is not required to pay a license renewal fee. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by changing Section
521B-40 as follows:
 
6    (105 ILCS 5/21B-40)
7    Sec. 21B-40. Fees.
8    (a) Beginning with the start of the new licensure system
9established pursuant to this Article, the following fees shall
10be charged to applicants:
11        (1) A $75 application fee for a Professional Educator
12    License or an Educator License with Stipulations. However,
13    beginning on January 1, 2015, the application fee for a
14    Professional Educator License and Educator License with
15    Stipulations shall be $100. Beginning on July 1, 2018, a
16    licensee who holds a paraprofessional educator endorsement
17    on an Educator License with Stipulations is not required to
18    pay a license renewal fee.
19        (1.5) A $50 application fee for a Substitute Teaching
20    License. If the application for a Substitute Teaching
21    License is made and granted after July 1, 2017, the
22    licensee may apply for a refund of the application fee
23    within 18 months of issuance of the new license and shall

1    be issued that refund by the State Board of Education if
2    the licensee provides evidence to the State Board of
3    Education that the licensee has taught pursuant to the
4    Substitute Teaching License at least 10 full school days
5    within one year of issuance.
6        (2) A $150 application fee for individuals who have not
7    been entitled by an Illinois-approved educator preparation
8    program at an Illinois institution of higher education and
9    are seeking any of the licenses set forth in subdivision
10    (1) of this subsection (a).
11        (3) A $50 application fee for each endorsement or
12    approval an individual holding a license wishes to add to
13    that license.
14        (4) A $10 per year registration fee for the course of
15    the validity cycle to register the license, which shall be
16    paid to the regional office of education having supervision
17    and control over the school in which the individual holding
18    the license is to be employed. If the individual holding
19    the license is not yet employed, then the license may be
20    registered in any county in this State. The registration
21    fee must be paid in its entirety the first time the
22    individual registers the license for a particular validity
23    period in a single region. No additional fee may be charged
24    for that validity period should the individual
25    subsequently register the license in additional regions.
26    An individual must register the license (i) immediately

1    after initial issuance of the license and (ii) at the
2    beginning of each renewal cycle if the individual has
3    satisfied the renewal requirements required under this
4    Code.
5        Beginning on July 1, 2017, at the beginning of each
6    renewal cycle, individuals who hold a Substitute Teaching
7    License may apply for a reimbursement of the registration
8    fee within 18 months of renewal and shall be issued that
9    reimbursement by the State Board of Education from funds
10    appropriated for that purpose if the licensee provides
11    evidence to the State Board of Education that the licensee
12    has taught pursuant to the Substitute Teaching License at
13    least 10 full school days within one year of renewal.
14    (b) All application fees paid pursuant to subdivisions (1)
15through (3) of subsection (a) of this Section shall be
16deposited into the Teacher Certificate Fee Revolving Fund and
17shall be used, subject to appropriation, by the State Board of
18Education to provide the technology and human resources
19necessary for the timely and efficient processing of
20applications and for the renewal of licenses. Funds available
21from the Teacher Certificate Fee Revolving Fund may also be
22used by the State Board of Education to support the recruitment
23and retention of educators, to support educator preparation
24programs as they seek national accreditation, and to provide
25professional development aligned with the requirements set
26forth in Section 21B-45 of this Code. A majority of the funds

1in the Teacher Certificate Fee Revolving Fund must be dedicated
2to the timely and efficient processing of applications and for
3the renewal of licenses. The Teacher Certificate Fee Revolving
4Fund is not subject to administrative charge transfers,
5authorized under Section 8h of the State Finance Act, from the
6Teacher Certificate Fee Revolving Fund into any other fund of
7this State, and moneys in the Teacher Certificate Fee Revolving
8Fund shall not revert back to the General Revenue Fund at any
9time.
10    The regional superintendent of schools shall deposit the
11registration fees paid pursuant to subdivision (4) of
12subsection (a) of this Section into the institute fund
13established pursuant to Section 3-11 of this Code.
14    (c) The State Board of Education and each regional office
15of education are authorized to charge a service or convenience
16fee for the use of credit cards for the payment of license
17fees. This service or convenience fee shall not exceed the
18amount required by the credit card processing company or vendor
19that has entered into a contract with the State Board or
20regional office of education for this purpose, and the fee must
21be paid to that company or vendor.
22    (d) If, at the time a certificate issued under Article 21
23of this Code is exchanged for a license issued under this
24Article, a person has paid registration fees for any years of
25the validity period of the certificate and these years have not
26expired when the certificate is exchanged, then those fees must

1be applied to the registration of the new license.
