AMENDMENT TO HOUSE BILL 3888

AMENDMENT NO. ______. Amend House Bill 3888 by replacing everything after the enacting clause with the following:

"Section 5. The River Edge Redevelopment Zone Act is amended by changing Section 10-4 as follows:

(65 ILCS 115/10-4)

Sec. 10-4. Qualifications for River Edge Redevelopment Zones.

(a) Before the effective date of this amendatory Act of the 100th General Assembly, an An area is qualified to become a zone if it:

(1) is a contiguous area adjacent to or surrounding a river;

(2) comprises a minimum of one half square mile and not more than 12 square miles, exclusive of lakes and waterways;

(3) satisfies any additional criteria established by the Department consistent with the purposes of this Act;

(4) is entirely within a single municipality; and

(5) has at least 100 acres of environmentally challenged land within 1500 yards of the riverfront.

The changes made by this amendatory Act of the 100th General Assembly do not affect the certification of any area certified by the Department as a River Edge Redevelopment Zone under this subsection before the effective date of this amendatory Act of the 100th General Assembly.

(b) On and after the effective date of this amendatory Act of the 100th General Assembly, an area is qualified to become a zone if it is an area in the State:

(1) located on a river;

(2) with less than 30,000 population; and

(3) that meets one of the following conditions:

(i) has a median household income of less than 80% of State median income for a household of 4, as determined by the U.S. Department of Housing and Urban Development;

(ii) has a per capita personal income of less than 60% of the per capita personal income for Illinois as determined by the U.S. Department of Commerce; or

(iii) has a median home price of less than 60% of the State median home price.

Section 99. Effective date. This Act takes effect upon becoming law.".
