| 1 | | AMENDMENT TO HOUSE BILL 3292
| 2 | | AMENDMENT NO. ______. Amend House Bill 3292 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 5. The State Property Control Act is amended by | 5 | | changing Section 7.3 and by adding Section 8.4 as follows:
| 6 | | (30 ILCS 605/7.3) (from Ch. 127, par. 133b10.3)
| 7 | | Sec. 7.3.
The Administrator shall have charge of all | 8 | | transferable property
and shall have authority to take | 9 | | possession and control of such property
in order to transfer or | 10 | | assign any such property to any other State agency
that has | 11 | | need or use for such property or to dispose of said property in
| 12 | | accordance with Section 7 of this Act.
| 13 | | The Administrator may not dispose of a transferable | 14 | | airplane by sale until
he or she determines that
(i) the agency | 15 | | no longer has a need for the airplane, (ii) the airplane will
| 16 | | not be used as a trade-in on another aircraft, and (iii)
no |

| 1 | | public university or college in Illinois that
offers courses in | 2 | | aviation, flight training, or other subjects involving
| 3 | | knowledge of the workings of an airplane has listed the need | 4 | | for an airplane as
provided in this Section.
| 5 | | Responsible officers shall periodically report all | 6 | | transferable property
at locations under their jurisdictions | 7 | | to the Administrator. The Administrator
shall review such | 8 | | reports and arrange for physical examination of said property
| 9 | | if necessary to determine if said items of transferable | 10 | | property should
be transferred to another State agency, | 11 | | transferred to a central warehouse,
or disposed of. The | 12 | | Administrator shall advise responsible officers of
the results | 13 | | of these reviews as necessary.
| 14 | | The staff under the jurisdiction of the Administrator shall | 15 | | review as
necessary
State agencies' inventories for potential | 16 | | items of transferable property.
If in the opinion of the | 17 | | Administrator's staff, any property appears to
be | 18 | | transferable, the Administrator shall notify the responsible | 19 | | officer
of his determination. The executive head of the agency | 20 | | holding the property
in question may appeal the determination | 21 | | in writing to the Administrator.
| 22 | | The Administrator will review the determination in | 23 | | accordance with rules
and procedures established pursuant to | 24 | | Section 5 of this Act.
| 25 | | The Administrator shall maintain lists of transferable | 26 | | property and of
State agency needs for such property and will |

| 1 | | transfer where appropriate listed
transferable property to | 2 | | agencies listing their needs for such property
as detailed by | 3 | | their responsible officers.
The Administrator must give | 4 | | priority for transfer of an airplane, that is not
to be used as | 5 | | a trade-in, to a public
university or college in Illinois that | 6 | | offers courses in aviation, flight
training, or other subjects | 7 | | involving knowledge of the workings of an airplane
and that has | 8 | | listed the need for an airplane.

| 10 | | (30 ILCS 605/8.4 new) | 11 | | Sec. 8.4. Aircraft. | 12 | | (a) Except as provided in subsection (b) of this Section, | 13 | | the Administrator may not dispose of a transferable airplane by | 14 | | sale until he or she determines that (i) the agency no longer | 15 | | has a need for the airplane, (ii) the airplane will not be used | 16 | | as a trade-in on another aircraft, and (iii) no public | 17 | | university or college in Illinois that offers courses in | 18 | | aviation, flight training, or other subjects involving | 19 | | knowledge of the workings of an airplane has listed the need | 20 | | for an airplane. The Administrator must give priority for | 21 | | transfer of an airplane, that is not to be used as a trade-in, | 22 | | to a public university or college in Illinois that offers | 23 | | courses in aviation, flight training, or other subjects | 24 | | involving knowledge of the workings of an airplane and that has | 25 | | listed the need for an airplane. |

| 1 | | (b) Notwithstanding any other provision of law to the | 2 | | contrary, all airplanes and helicopters owned by the State on | 3 | | the effective date of this amendatory Act of the 100th General | 4 | | Assembly, except those designated for emergency use under a | 5 | | plan developed pursuant to Section 3.120 of the Emergency | 6 | | Medical Services (EMS) Systems Act, those used by the | 7 | | Department of State Police, and those used by a public | 8 | | university or college as part of a course offered in aviation, | 9 | | flight training, or any other subject involving knowledge of | 10 | | the workings of an airplane, are deemed surplus and shall be | 11 | | sold by the Administrator as soon as possible after the | 12 | | effective date of this amendatory Act of the 100th General | 13 | | Assembly using a competitive sealed bid method of sale. | 14 | | Proceeds from the sale of those airplanes and helicopters shall | 15 | | be deposited into the Education Assistance Fund.
| 16 | | Section 99. Effective date. This Act takes effect upon | 17 | | becoming law.".
