AMENDMENT TO HOUSE BILL 3292

2    AMENDMENT NO. ______. Amend House Bill 3292 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The State Property Control Act is amended by
5changing Section 7.3 and by adding Section 8.4 as follows:
 
6    (30 ILCS 605/7.3)  (from Ch. 127, par. 133b10.3)
7    Sec. 7.3. The Administrator shall have charge of all
8transferable property and shall have authority to take
9possession and control of such property in order to transfer or
10assign any such property to any other State agency that has
11need or use for such property or to dispose of said property in
12accordance with Section 7 of this Act.
13    The Administrator may not dispose of a transferable
14airplane by sale until he or she determines that (i) the agency
15no longer has a need for the airplane, (ii) the airplane will
16not be used as a trade-in on another aircraft, and (iii) no

1public university or college in Illinois that offers courses in
2aviation, flight training, or other subjects involving
3knowledge of the workings of an airplane has listed the need
4for an airplane as provided in this Section.
5    Responsible officers shall periodically report all
6transferable property at locations under their jurisdictions
7to the Administrator. The Administrator shall review such
8reports and arrange for physical examination of said property
9if necessary to determine if said items of transferable
10property should be transferred to another State agency,
11transferred to a central warehouse, or disposed of. The
12Administrator shall advise responsible officers of the results
13of these reviews as necessary.
14    The staff under the jurisdiction of the Administrator shall
15review as necessary State agencies' inventories for potential
16items of transferable property. If in the opinion of the
17Administrator's staff, any property appears to be
18transferable, the Administrator shall notify the responsible
19officer of his determination. The executive head of the agency
20holding the property in question may appeal the determination
21in writing to the Administrator.
22    The Administrator will review the determination in
23accordance with rules and procedures established pursuant to
24Section 5 of this Act.
25    The Administrator shall maintain lists of transferable
26property and of State agency needs for such property and will

1transfer where appropriate listed transferable property to
2agencies listing their needs for such property as detailed by
3their responsible officers. The Administrator must give
4priority for transfer of an airplane, that is not to be used as
5a trade-in, to a public university or college in Illinois that
6offers courses in aviation, flight training, or other subjects
7involving knowledge of the workings of an airplane and that has
8listed the need for an airplane.

10    (30 ILCS 605/8.4 new)
11    Sec. 8.4. Aircraft.
12    (a) Except as provided in subsection (b) of this Section,
13the Administrator may not dispose of a transferable airplane by
14sale until he or she determines that (i) the agency no longer
15has a need for the airplane, (ii) the airplane will not be used
16as a trade-in on another aircraft, and (iii) no public
17university or college in Illinois that offers courses in
18aviation, flight training, or other subjects involving
19knowledge of the workings of an airplane has listed the need
20for an airplane. The Administrator must give priority for
21transfer of an airplane, that is not to be used as a trade-in,
22to a public university or college in Illinois that offers
23courses in aviation, flight training, or other subjects
24involving knowledge of the workings of an airplane and that has
25listed the need for an airplane.

1    (b) Notwithstanding any other provision of law to the
2contrary, all airplanes and helicopters owned by the State on
3the effective date of this amendatory Act of the 100th General
4Assembly, except those designated for emergency use under a
5plan developed pursuant to Section 3.120 of the Emergency
6Medical Services (EMS) Systems Act, those used by the
7Department of State Police, and those used by a public
8university or college as part of a course offered in aviation,
9flight training, or any other subject involving knowledge of
10the workings of an airplane, are deemed surplus and shall be
11sold by the Administrator as soon as possible after the
12effective date of this amendatory Act of the 100th General
13Assembly using a competitive sealed bid method of sale.
14Proceeds from the sale of those airplanes and helicopters shall
15be deposited into the Education Assistance Fund.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
