AMENDMENT TO SENATE BILL 3335

2    AMENDMENT NO. ______. Amend Senate Bill 3335 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Emergency Medical Services (EMS) Systems
5Act is amended by changing Section 3.55 as follows:
 
6    (210 ILCS 50/3.55)
7    Sec. 3.55. Scope of practice.
8    (a) Any person currently licensed as an EMR, EMT, EMT-I,
9A-EMT, or Paramedic may perform emergency and non-emergency
10medical services as defined in this Act, in accordance with his
11or her level of education, training and licensure, the
12standards of performance and conduct prescribed by the
13Department in rules adopted pursuant to this Act, and the
14requirements of the EMS System in which he or she practices, as
15contained in the approved Program Plan for that System. The
16Director may, by written order, temporarily modify individual

1scopes of practice in response to public health emergencies for
2periods not exceeding 180 days.
3    (a-5) EMS personnel who have successfully completed a
4Department approved course in automated defibrillator
5operation and who are functioning within a Department approved
6EMS System may utilize such automated defibrillator according
7to the standards of performance and conduct prescribed by the
8Department in rules adopted pursuant to this Act and the
9requirements of the EMS System in which they practice, as
10contained in the approved Program Plan for that System.
11    (a-7) An EMT, EMT-I, A-EMT, or Paramedic who has
12successfully completed a Department approved course in the
13administration of epinephrine shall be required to carry
14epinephrine with him or her as part of the EMS personnel
15medical supplies whenever he or she is performing official
16duties as determined by the EMS System. The epinephrine may be
17administered from a glass vial, auto-injector, ampule, or
18pre-filled syringe.
19    (b) An EMR, EMT, EMT-I, A-EMT, or Paramedic may practice as
20an EMR, EMT, EMT-I, A-EMT, or Paramedic or utilize his or her
21EMR, EMT, EMT-I, A-EMT, or Paramedic license in pre-hospital or
22inter-hospital emergency care settings or non-emergency
23medical transport situations, under the written or verbal
24direction of the EMS Medical Director. For purposes of this
25Section, a "pre-hospital emergency care setting" may include a
26location, that is not a health care facility, which utilizes

1EMS personnel to render pre-hospital emergency care prior to
2the arrival of a transport vehicle. The location shall include
3communication equipment and all of the portable equipment and
4drugs appropriate for the EMR, EMT, EMT-I, A-EMT, or
5Paramedic's level of care, as required by this Act, rules
6adopted by the Department pursuant to this Act, and the
7protocols of the EMS Systems, and shall operate only with the
8approval and under the direction of the EMS Medical Director.
9    This Section shall not prohibit an EMR, EMT, EMT-I, A-EMT,
10or Paramedic from practicing within an emergency department or
11other health care setting for the purpose of receiving
12continuing education or training approved by the EMS Medical
13Director. This Section shall also not prohibit an EMT, EMT-I,
14A-EMT, or Paramedic from seeking credentials other than his or
15her EMT, EMT-I, A-EMT, or Paramedic license and utilizing such
16credentials to work in emergency departments or other health
17care settings under the jurisdiction of that employer.
18    (c) An EMT, EMT-I, A-EMT, or Paramedic may honor Do Not
19Resuscitate (DNR) orders and powers of attorney for health care
20only in accordance with rules adopted by the Department
21pursuant to this Act and protocols of the EMS System in which
22he or she practices.
23    (d) A student enrolled in a Department approved EMS
24personnel program, while fulfilling the clinical training and
25in-field supervised experience requirements mandated for
26licensure or approval by the System and the Department, may

1perform prescribed procedures under the direct supervision of a
2physician licensed to practice medicine in all of its branches,
3a qualified registered professional nurse, or qualified EMS
4personnel, only when authorized by the EMS Medical Director.
