AMENDMENT TO SENATE BILL 2974

2    AMENDMENT NO. ______. Amend Senate Bill 2974 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Vehicle Code is amended by
5changing Sections 3-806.3 and 3-808.1 as follows:
 
6    (625 ILCS 5/3-806.3)  (from Ch. 95 1/2, par. 3-806.3)
7    Sec. 3-806.3. Senior Citizens. Commencing with the 2009
8registration year, the registration fee paid by any vehicle
9owner who has been approved for benefits under the Senior
10Citizens and Persons with Disabilities Property Tax Relief Act
11or who is the spouse of such a person shall be $24 instead of
12the fee otherwise provided in this Code for passenger cars
13displaying standard multi-year registration plates issued
14under Section 3-414.1, motor vehicles displaying special
15registration plates issued under Section 3-609, 3-616, 3-621,
163-622, 3-623, 3-624, 3-625, 3-626, 3-628, 3-638, 3-642, 3-645,

13-647, 3-650, 3-651, or 3-663, motor vehicles registered at
28,000 pounds or less under Section 3-815(a), and recreational
3vehicles registered at 8,000 pounds or less under Section
43-815(b). Widows and widowers of claimants shall also be
5entitled to this reduced registration fee for the registration
6year in which the claimant was eligible.
7    Commencing with the 2009 registration year, the
8registration fee paid by any vehicle owner who has claimed and
9received a grant under the Senior Citizens and Persons with
10Disabilities Property Tax Relief Act or who is the spouse of
11such a person shall be $24 instead of the fee otherwise
12provided in this Code for passenger cars displaying standard
13multi-year registration plates issued under Section 3-414.1,
14motor vehicles displaying special registration plates issued
15under Section 3-607, 3-609, 3-616, 3-621, 3-622, 3-623, 3-624,
163-625, 3-626, 3-628, 3-638, 3-642, 3-645, 3-647, 3-650, 3-651,
173-663, or 3-664, motor vehicles registered at 8,000 pounds or
18less under Section 3-815(a), and recreational vehicles
19registered at 8,000 pounds or less under Section 3-815(b).
20Widows and widowers of claimants shall also be entitled to this
21reduced registration fee for the registration year in which the
22claimant was eligible.
23    Commencing with the 2017 registration year, the reduced fee
24under this Section shall apply to any special registration
25plate authorized in Article VI of Chapter 3 of this Code, for
26which the applicant would otherwise be eligible.

1    Surcharges for vehicle registrations under Section 3-806
2of this Code shall not be collected from any vehicle owner who
3has been approved for benefits under the Senior Citizens and
4Disabled Persons Property Tax Relief Act or a person who is the
5spouse of such a person.
6    No more than one reduced registration fee under this
7Section shall be allowed during any 12-month 12 month period
8based on the primary eligibility of any individual, whether
9such reduced registration fee is allowed to the individual or
10to the spouse, widow or widower of such individual. This
11Section does not apply to the fee paid in addition to the
12registration fee for motor vehicles displaying vanity,
13personalized, or special license plates.

17    Sec. 3-808.1. (a) Permanent vehicle registration plates
18shall be issued, at no charge, to the following:
19        1. Vehicles, other than medical transport vehicles,
20    owned and operated by the State of Illinois or by any State
21    agency financed by funds appropriated by the General
22    Assembly;
23        2. Special disability plates issued to vehicles owned
24    and operated by the State of Illinois or by any State
25    agency financed by funds appropriated by the General

1    Assembly.
2    (b) Permanent vehicle registration plates shall be issued,
3for a one time fee of $8.00, to the following:
4        1. Vehicles, other than medical transport vehicles,
5    operated by or for any county, township or municipal
6    corporation.
7        2. Vehicles owned by counties, townships or municipal
8    corporations for persons with disabilities.
9        3. Beginning with the 1991 registration year,
10    county-owned vehicles operated by or for any county sheriff
11    and designated deputy sheriffs. These registration plates
12    shall contain the specific county code and unit number.
13        4. All-terrain vehicles owned by counties, townships,
14    or municipal corporations and used for law enforcement
15    purposes when the Manufacturer's Statement of Origin is
16    accompanied with a letter from the original manufacturer or
17    a manufacturer's franchised dealer stating that this
18    all-terrain vehicle has been converted to a street worthy
19    vehicle that meets the equipment requirements set forth in
20    Chapter 12 of this Code.
21        5. Beginning with the 2001 registration year,
22    municipally-owned vehicles operated by or for any police
23    department. These registration plates shall contain the
24    designation "municipal police" and shall be numbered and
25    distributed as prescribed by the Secretary of State.
26        6. Beginning with the 2014 registration year,

1    municipally owned, fire district owned, or Mutual Aid Box
2    Alarm System (MABAS) owned vehicles operated by or for any
3    fire department, fire protection district, or MABAS. These
4    registration plates shall display the designation "Fire
5    Department" and shall display the specific fire
6    department, fire district, fire unit, or MABAS division
7    number or letter.
8        7. Beginning with the 2017 registration year, vehicles
9    that do not require a school bus driver permit under
10    Section 6-104 to operate, and are owned by a public school
11    district from grades K-12 or a public community college.
12        8. Beginning with the 2017 registration year, vehicles
13    of the first division or vehicles of the second division
14    weighing not more than 8,000 pounds that are owned by a
15    medical facility or hospital of a municipality, county, or
16    township.
17    (b-5) Beginning with the 2016 registration year, permanent
18vehicle registration plates shall be issued for a one-time fee
19of $8.00 to a county, township, or municipal corporation that
20owns or operates vehicles used for the purpose of community
21workplace commuting as defined by the Secretary of State by
22administrative rule. The design and color of the plates shall
23be wholly within the discretion of the Secretary. The Secretary
24of State may adopt rules to implement this subsection (b-5).
25    (c) Beginning with the 2012 registration year,
26county-owned vehicles operated by or for any county sheriff and

1designated deputy sheriffs that have been issued registration
2plates under subsection (b) of this Section shall be exempt
3from any fee for the transfer of registration from one vehicle
4to another vehicle. Each county sheriff shall report to the
5Secretary of State any transfer of registration plates from one
6vehicle to another vehicle operated by or for any county
7sheriff and designated deputy sheriffs. The Secretary of State
8shall adopt rules to implement this subsection (c).
9    (c-5) Beginning with the 2014 registration year,
10municipally owned, fire district owned, or Mutual Aid Box Alarm
11System (MABAS) owned vehicles operated by or for any fire
12department, fire protection district, or MABAS that have been
13issued registration plates under subsection (b) of this Section
14shall be exempt from any fee for the transfer of registration
15from one vehicle to another vehicle. Each fire department, fire
16protection district, of MABAS shall report to the Secretary of
17State any transfer of registration plates from one vehicle to
18another vehicle operated by or for any fire department, fire
19protection district, or MABAS. The Secretary of State shall
20adopt rules to implement this subsection.
21    (d) Beginning with the 2013 registration year,
22municipally-owned vehicles operated by or for any police
23department that have been issued registration plates under
24subsection (b) of this Section shall be exempt from any fee for
25the transfer of registration from one vehicle to another
26vehicle. Each municipal police department shall report to the

1Secretary of State any transfer of registration plates from one
2vehicle to another vehicle operated by or for any municipal
3police department. The Secretary of State shall adopt rules to
4implement this subsection (d).
5    (e) Beginning with the 2016 registration year, any vehicle
6owned or operated by a county, township, or municipal
7corporation that has been issued registration plates under this
8Section is exempt from any fee for the transfer of registration
9from one vehicle to another vehicle. Each county, township, or
10municipal corporation shall report to the Secretary of State
11any transfer of registration plates from one vehicle to another
12vehicle operated by or for any county, township, or municipal
13corporation.

16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
