AMENDMENT TO SENATE BILL 2894

2    AMENDMENT NO. ______. Amend Senate Bill 2894 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Pension Code is amended by
5changing Section 7-155 as follows:
 
6    (40 ILCS 5/7-155)  (from Ch. 108 1/2, par. 7-155)
7    Sec. 7-155. Surviving spouse annuities-commencement.
8    (a) A surviving spouse annuity shall begin on the 1st day
9of the month next following the month in which the
10participating employee, or the employee annuitant or such
11person entitled to a retirement annuity died, upon a written
12application therefor, provided:
13        1. Any such annuity payments payable for periods
14    beginning Such date is not more than one year prior to the
15    date the application was received by the Board shall not
16    include interest based on late payment; and

1        2. The amount of surviving spouse annuity before the
2    application of paragraph 3 of Section 7-158, is at least $5
3    per month, beginning on such date.
4    (b) A person receiving a surviving spouse annuity whose
5annuity was granted but limited to one year prior to the
6application date under the former provisions of this Section
7may reapply for annuity payments for the period denied due to
8the one-year limitation. Such annuity payments shall not
9include interest based on late payment.
10    (c) The changes to this Section made by this amendatory Act
11of the 99th General Assembly apply without regard to whether
12the deceased spouse was in service on or after the effective
13date of this amendatory Act.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.".
