AMENDMENT TO SENATE BILL 2838

AMENDMENT NO. ______. Amend Senate Bill 2838 by replacing everything after the enacting clause with the following:

"Section 5. The Illinois Vehicle Code is amended by adding Section 11-1413.5 as follows:

(625 ILCS 5/11-1413.5 new)

Sec. 11-1413.5. Ice and snow removal from vehicle.

(a) A person operating a vehicle of the second division weighing more than 8,000 pounds upon a highway of this State shall remove any ice and snow from the hood, roof, and sides of the vehicle that poses a threat to the safety of other persons or property on the highway during operation of the vehicle.

(b) This Section shall not apply to:

(1) a person operating a vehicle during a period of snow, sleet, or freezing rain if the period began and continued during the vehicle operation;

(2) a person operating a vehicle when the vehicle is parked; or

(3) a person operating an authorized emergency vehicle or a highway maintenance vehicle.

(c) A person who violates this Section shall be guilty of a petty offense and shall be fined not more than $25 for a first offense and not more than $50 for a second or subsequent offense.".
