| 1 | | AN ACT concerning regulation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The MC/DD Act is amended by adding Section 2-204 |
| 5 | | as follows:
|

| 7 | | Sec. 2-204. DD Facility Advisory Board. The DD Facility |
| 8 | | Advisory Board established under Section 2-204 of the ID/DD |
| 9 | | Community Care Act shall advise the Department of Public Health |
| 10 | | on all aspects of its responsibilities under this Act, |
| 11 | | including the format and content of any rules adopted by the |
| 12 | | Department of Public Health. Any such rules, except emergency |
| 13 | | rules adopted pursuant to Section 5-45 of the Illinois |
| 14 | | Administrative Procedure Act, adopted without obtaining the |
| 15 | | advice of the DD Facility Advisory Board are null and void. If |
| 16 | | the Department fails to follow the advice of the DD Facility |
| 17 | | Advisory Board, the Department shall, prior to the adoption of |
| 18 | | such rules, transmit a written explanation of the reason |
| 19 | | therefor to the DD Facility Advisory Board. During its review |
| 20 | | of rules, the DD Facility Advisory Board shall analyze the |
| 21 | | economic and regulatory impact of those rules. If the DD |
| 22 | | Facility Advisory Board, having been asked for its advice, |
| 23 | | fails to advise the Department within 90 days, the rules shall |
