AMENDMENT TO SENATE BILL 1466

2    AMENDMENT NO. ______. Amend Senate Bill 1466 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. This Act may be referred to as Lali's Law.
 
5    Section 5. The Pharmacy Practice Act is amended by adding
6Section 19.1 as follows:
 
7    (225 ILCS 85/19.1 new)
8    Sec. 19.1. Dispensing naloxone antidotes.
9    (a) Due to the recent rise in opioid-related deaths in
10Illinois and the existence of an opioid antidote that can
11reverse the deadly effects of overdose, the General Assembly
12finds that in order to avoid further loss where possible, it is
13responsible to allow greater access of such an antidote to
14those populations at risk of overdose.
15    (b) Notwithstanding any general or special law to the

1contrary, a licensed pharmacist may dispense an opioid
2antagonist in accordance with written, standardized procedures
3or protocols developed by the Department with the Department of
4Public Health and the Department of Human Services, if such
5procedures or protocols are filed at the pharmacist's place of
6practice and with the Board before implementation.
7    (c) A health care practitioner may prescribe naloxone
8antidotes in the name of a licensed pharmacist for use in
9accordance with this Act, and pharmacists may dispense opioid
10antidotes pursuant to a prescription issued in the name of an
11authorized entity. Such prescriptions shall be valid for a
12period of 2 years.
13    (d) Before dispensing an opioid antidote pursuant to this
14Section, a pharmacist shall complete a training program
15approved by the Department of Human Services pursuant to
16Section 5-23 of the Alcoholism and Other Drug Abuse and
17Dependency Act. The training program shall include, but not be
18limited to, proper documentation and quality assurance.
19    (e) For the purpose of this Section:
20    "Health care practitioner" means a physician licensed to
21practice medicine in all its branches, dentist, veterinarian,
22podiatric physician, optometrist, physician assistant, or an
23advanced practice nurse.
24    "Opioid antidote" means a dose of naloxone hydrochloride or
25any other similarly acting and equally safe drug approved by
26the United States Food and Drug Administration.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
