AMENDMENT TO SENATE BILL 1430

2    AMENDMENT NO. ______. Amend Senate Bill 1430 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Property Tax Code is amended by changing
5Section 3-70 as follows:
 
6    (35 ILCS 200/3-70)
7    Sec. 3-70. Cessation of Township Assessor.
8    (a) If the office of Township Assessor in a coterminous
9township ceases as provided in Article 27 of the Township Code,
10then the coterminous municipality shall assume the duties of
11the Township Assessor under this Code.
12    (b) If the office of Township Assessor ceases as provided
13in Article 28 of the Township Code, then the Supervisor of
14Assessments or County Assessor, as applicable, shall assume the
15duties of the Township Assessor under this Code.

1    Section 10. The Township Code is amended by adding Article
228 as follows:

ARTICLE 28. DISCONTINUANCE OF THE OFFICE OF TOWNSHIP ASSESSOR

 
5    (60 ILCS 1/28-5 new)
6    Sec. 28-5. Referendum to discontinue all offices of
7township assessor in a county.
8    (a) The office of township assessor may be discontinued by
9referendum in all townships lying wholly within a county's
10borders upon (i) adoption of a resolution by the county board
11for the voters to approve by referendum the discontinuance of
12all township assessors, or (ii) filing of a petition, subject
13to the petition requirements of Section 28-3 of the Election
14Code, with the county board to approve by referendum the
15discontinuance of all township assessors signed by at least 10%
16of the registered voters of the county.
17    (b) Upon adoption of the resolution or filing of the
18petition under subsection (a), the county board shall certify
19the question to the appropriate election officials and file
20with the county clerk. The resolution or petition shall be
21filed with the county clerk not less than 79 days prior to the
22general election in which the referendum will appear.

2    Sec. 28-10. Referendum; approval. If a petition for a
3referendum is filed with the county clerk that meets the
4requirements of Section 27-5 of this Article, a referendum,
5subject to the requirements of 16-7 of the Election Code, shall
6be placed on the ballot at the next general election in
7substantially the following form:
8        Shall the office of township assessor be abolished in
9    all townships in … County and the duties of each township
10    assessor be transferred to the county assessor or county
11    supervisor of assessments.
12The votes shall be recorded as "Yes" or "No." The referendum is
13approved when a majority of the voters approve of the
14referendum. If approved, then the office of township assessor
15shall cease in each township in the county at the end of the
16current term of office of each township assessor. At the end of
17each township assessor's term (i) the county supervisor of
18assessments or county assessor, as applicable, shall assume the
19duties of the township assessor under the Property Tax Code,
20(ii) the county board members shall be the board of health for
21the public health district under the Public Health District
22Act, and (iii) the Office of the Township Collector shall also
23cease.
 
24    Section 15. The Public Health District Act is amended by
25adding Section 27 as follows:

2    Sec. 27. Cessation of township assessor. If the office of
3township assessor ceases as provided in Article 28 of the
4Township Code, then the county board members shall be the board
5of health for the public health district under this Act.".
