SYNOPSIS AS INTRODUCED:
 
5 ILCS 120/1.02  from Ch. 102, par. 41.02
5 ILCS 120/2.07 new

    Amends the Open Meetings Act. Requires each board to stream or simulcast its meetings on its official website in real time. Provides that each board must make the video of each meeting available for a period of one year after the date of the meeting or until the meeting has been reduced to detailed minutes and transcripts, whichever is later. Requires each board to post on its official website the agenda of a meeting 6 days before the meeting date, except in the case of an emergency meeting. Defines "board" as public bodies to which the Governor appoints one or more members.

1    AN ACT concerning transparency.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Open Meetings Act is amended by changing
5Section 1.02 and by adding Section 2.07 as follows:
 
6    (5 ILCS 120/1.02)  (from Ch. 102, par. 41.02)
7    Sec. 1.02. For the purposes of this Act:
8    "Board" means public bodies to which the Governor appoints
9one or more members.
10    "Meeting" means any gathering, whether in person or by
11video or audio conference, telephone call, electronic means
12(such as, without limitation, electronic mail, electronic
13chat, and instant messaging), or other means of contemporaneous
14interactive communication, of a majority of a quorum of the
15members of a public body held for the purpose of discussing
16public business or, for a 5-member public body, a quorum of the
17members of a public body held for the purpose of discussing
18public business.
19    Accordingly, for a 5-member public body, 3 members of the
20body constitute a quorum and the affirmative vote of 3 members
21is necessary to adopt any motion, resolution, or ordinance,
22unless a greater number is otherwise required.
23    "Public body" includes all legislative, executive,

1administrative or advisory bodies of the State, counties,
2townships, cities, villages, incorporated towns, school
3districts and all other municipal corporations, boards,
4bureaus, committees or commissions of this State, and any
5subsidiary bodies of any of the foregoing including but not
6limited to committees and subcommittees which are supported in
7whole or in part by tax revenue, or which expend tax revenue,
8except the General Assembly and committees or commissions
9thereof. "Public body" includes tourism boards and convention
10or civic center boards located in counties that are contiguous
11to the Mississippi River with populations of more than 250,000
12but less than 300,000. "Public body" includes the Health
13Facilities and Services Review Board. "Public body" does not
14include a child death review team or the Illinois Child Death
15Review Teams Executive Council established under the Child
16Death Review Team Act, an ethics commission acting under the
17State Officials and Employees Ethics Act, a regional youth
18advisory board or the Statewide Youth Advisory Board
19established under the Department of Children and Family
20Services Statewide Youth Advisory Board Act, or the Illinois
21Independent Tax Tribunal.

25    (a) Notwithstanding any other provision of this Act to the

1contrary, and except as provided in subsection (b) of this
2Section, each board must stream or simulcast its meetings on
3its official website as the meeting occurs in real time. Each
4board must keep the video of each meeting for a period of one
5year after the meeting date or until the meeting has been
6reduced to detailed minutes and transcripts, whichever is
7later.
8    (b) Each board must post its meeting agenda on its official
9website at least 6 days prior to the meeting. In the case of an
10emergency meeting, each board must post that agenda as soon as
11it is able.
