SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-360 new

    Amends the Civil Administrative Code of Illinois. Exempts certain health care professionals licensed to practice in another state or country from State licensure requirements if the professional is practicing in the State while under contract to provide services to an athletic team. Defines "athletic team". Limits the services the health care professional may provide. Limits the licensing exemption period to 10 days per sporting event. Authorizes the Secretary of Financial and Professional Regulation to grant one 20-day extension to the exemption period. Provides that an exempt health care professional is not authorized to practice at a health care clinic or facility. Effective September 1, 2015.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law of
5the Civil Administrative Code of Illinois is amended by adding
6Section 2105-360 as follows:
 
7    (20 ILCS 2105/2105-360 new)
8    Sec. 2105-360. Licensing exemptions for athletic team
9health care professionals.
10    (a) Definitions. For purposes of this Section:
11    "Athletic team" means any professional or amateur level
12group organized for the purpose of engaging in athletic events
13that employs the services of a health care professional.
14    "Health care professional" means a physician, physical
15therapist, athletic trainer, acupuncturist, or massage
16therapist.
17    (b) Notwithstanding any other provision of law, a health
18care professional who is licensed to practice in another state
19or country shall be exempt from licensure requirements under
20the applicable Illinois professional Act while practicing his
21or her profession in this State if all of the following
22conditions are met:
23        (1) The health care professional has an oral or written

1    agreement with an athletic team to provide health care
2    services to the athletic team members, coaching staff, and
3    families traveling with the athletic team for a specific
4    sporting event to take place in this State.
5        (2) The health care professional may not provide care
6    or consultation to any person residing in this State other
7    than a person described in paragraph (1) of this subsection
8    (b) unless the care is covered under the Good Samaritan
9    Act.
10    (c) The exemption from licensure shall remain in force
11while the health care professional is traveling with the
12athletic team, but shall be no longer than 10 days per
13individual sporting event.
14    (d) The Secretary, upon prior written request by the health
15care professional, may grant the health care professional
16additional time of up to 20 additional days per sporting event.
17The total number of days the health care professional may be
18exempt, including additional time granted upon request, may not
19exceed 30 days per sporting event.
20    (e) A health care professional who is exempt from licensure
21requirements under this Section is not authorized to practice
22at a health care clinic or facility, including an acute care
23facility.
 
24    Section 99. Effective date. This Act takes effect September
251, 2015.
