AMENDMENT TO SENATE BILL 681

2    AMENDMENT NO. ______. Amend Senate Bill 681 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Exotic Weed Act is amended by
5changing Sections 3 and 4 as follows:
 
6    (525 ILCS 10/3)  (from Ch. 5, par. 933)
7    Sec. 3. Designated Exotic Weeds. Japanese honeysuckle
8(Lonicera japonica), multiflora rose (Rosa multiflora), purple
9loosestrife (Lythrum salicaria), common buckthorn (Rhamnus
10cathartica), glossy buckthorn (Rhamnus frangula), saw-toothed
11buckthorn (Rhamnus arguta), dahurian buckthorn (Rhamnus
12davurica), Japanese buckthorn (Rhamnus japonica), Chinese
13buckthorn (Rhamnus utilis), and kudzu (Pueraria lobata),
14exotic bush honeysuckles (Lonicera maackii, Lonicera tatarica,
15Lonicera morrowii, and Lonicera fragrantissima), exotic olives
16(Elaeagnus umbellata, Elaeagnus pungens, Elaeagnus

1angustifolia), salt cedar (all members of the Tamarix genus),
2poison hemlock (Conium maculatum), giant hogweed (Heracleum
3mantegazzianum), Oriental bittersweet (Celastrus orbiculatus),
4and lesser celandine (Ficaria verna), teasel (all members of
5the Dipsacus genus), and Japanese, giant, and Bohemian knotweed
6(Fallopia japonica, syn. Polygonum cuspidatum; Fallopia
7sachalinensis; and Fallopia x bohemica, resp.) are hereby
8designated exotic weeds. Upon petition the Director of Natural
9Resources, by rule, shall exempt varieties of any species
10listed in this Act that can be demonstrated by published or
11current research not to be an exotic weed as defined in Section
122.

15    Sec. 4. Control of Exotic Weeds.
16    (a) It shall be unlawful for any person, corporation,
17political subdivision, agency or department of the State to
18buy, sell, offer for sale, distribute or plant seeds, plants or
19plant parts of exotic weeds without a permit issued by the
20Department of Natural Resources. Such permits shall be issued
21only:
22        (1) for experiments into controlling and eradicating
23    exotic weeds; or
24        (2) for research to demonstrate that a variety of a
25    species listed in this Act is not an exotic weed as defined

1    in Section 2; or .
2        (3) for the use of exotic olive (Elaeagnus umbellata,
3    Elaeagnus pungens, Elaeagnus angustifolia) berries in the
4    manufacture of value added products, not to include the
5    resale of whole berries or seeds. The exotic berry permit
6    holder must register annually with the Department of
7    Natural Resources and be able to demonstrate to the
8    Department that seeds remaining post-manufacture are
9    sterile or otherwise unviable.
10    (b) The commercial propagation of exotic weeds for sale
11outside Illinois, certified under the Insect Pest and Plant
12Disease Act, is exempted from the provisions of this Section.
13    (c) The Department of Natural Resources may adopt rules for
14the administration of this Section.
