AMENDMENT TO SENATE BILL 679

2    AMENDMENT NO. ______. Amend Senate Bill 679 as follows:
 
3on page 1, line 5, immediately after "40", by inserting "and by
4adding Sections 42 and 51"; and
 
5on page 2, immediately below line 23, by inserting the
6following:
7    ""Commercial building" has the meaning ascribed to that
8term in subsection (d) of Section 10.09-1 of the Capital
9Development Board Act."; and
 
10on page 16, immediately below line 23, by inserting the
11following:
 
12    "(415 ILCS 98/42 new)
13    Sec. 42. Other State authorities.
14    (a) Any department, agency, instrumentality, or unit of

1local government of the State administering a program that
2involves the removal or replacement of mercury containing
3thermostats as a result of any statutory requirement, shall
4inform contractors of their statutory obligations to deliver
5the mercury-containing thermostats to a collection site and the
6prohibition on the disposal of those thermostats in a
7solid-waste facility.
8    (b) Any contractor, organization, or subcontractor of an
9organization who contracts with or receives funding or
10financing provided in whole or in part by or through any
11department, agency, instrumentality, or unit of local
12government of the State for the installation, service, or
13removal of heating, ventilation, or air-conditioning
14components resulting in the removal or handling of
15out-of-service mercury thermostats shall ensure the
16collection, transportation, and proper management of
17out-of-service mercury thermostats in accordance with the
18provisions this Act.
 
19    (415 ILCS 98/51 new)
20    Sec. 51. Removal of mercury thermostats from commercial
21buildings prior to demolition. Beginning January 1, 2016, no
22person shall demolish a commercial building unless (i) all
23mercury thermostats have been removed from the building and
24(ii) the person who removed the thermostats from the building
25has arranged for them to be delivered to a collection site

1established under this Act.".
