1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 12-604.1 and by adding Sections 1-218.10 and 12-604.3
6as follows:
 
7    (625 ILCS 5/1-218.10 new)
8    Sec. 1-218.10. Video event recorder. A video recorder
9placed inside a vehicle that continuously records, in a digital
10loop, audio, video, and G-force levels.

12    Sec. 12-604.1. Video devices.
13    (a) A person may not operate a motor vehicle if a
14television receiver, a video monitor, a television or video
15screen, or any other similar means of visually displaying a
16television broadcast or video signal that produces
17entertainment or business applications is operating and is
18located in the motor vehicle at any point forward of the back
19of the driver's seat, or is operating and visible to the driver
20while driving the motor vehicle.
21    (a-5) A person commits aggravated use of a video device
22when he or she violates subsection (a) and in committing the

1violation he or she was involved in a motor vehicle accident
2that results in great bodily harm, permanent disability,
3disfigurement, or death to another and the violation was a
4proximate cause of the injury or death.
5    (b) This Section does not apply to the following equipment,
6whether or not permanently installed in a vehicle:
7        (1) a vehicle information display;
8        (2) a global positioning display;
9        (3) a mapping or navigation display;
10        (4) a visual display used to enhance or supplement the
11    driver's view forward, behind, or to the sides of a motor
12    vehicle for the purpose of maneuvering the vehicle;
13        (5) television-type receiving equipment used
14    exclusively for safety or traffic engineering studies; or
15        (6) a television receiver, video monitor, television
16    or video screen, or any other similar means of visually
17    displaying a television broadcast or video signal, if that
18    equipment has an interlock device that, when the motor
19    vehicle is driven, disables the equipment for all uses
20    except as a visual display as described in paragraphs (1)
21    through (5) of this subsection (b).
22    (c) This Section does not apply to a mobile, digital
23terminal installed in an authorized emergency vehicle, a motor
24vehicle providing emergency road service or roadside
25assistance, or to motor vehicles utilized for public
26transportation.

1    (d) This Section does not apply to a television receiver,
2video monitor, television or video screen, or any other similar
3means of visually displaying a television broadcast or video
4signal if: (i) the equipment is permanently installed in the
5motor vehicle; and (ii) the moving entertainment images that
6the equipment displays are not visible to the driver while the
7motor vehicle is in motion.
8    (d-5) This Section does not apply to a video event
9recorder, as defined in Section 1-218.10 of this Code,
10installed in a contract carrier vehicle.
11    (e) Except as provided in subsection (f) of this Section, a
12person convicted of violating this Section is guilty of a petty
13offense and shall be fined not more than $100 for a first
14offense, not more than $200 for a second offense within one
15year of a previous conviction, and not more than $250 for a
16third or subsequent offense within one year of 2 previous
17convictions.
18    (f) A person convicted of violating subsection (a-5)
19commits a Class A misdemeanor if the violation resulted in
20great bodily harm, permanent disability, or disfigurement to
21another. A person convicted of violating subsection (a-5)
22commits a Class 4 felony if the violation resulted in the death
23of another person.

1    Sec. 12-604.3. Video event recorder notice. A contract
2carrier vehicle carrying passengers that is equipped with a
3video event recorder shall have a notice posted in a visible
4location stating that a passenger's conversation may be
5recorded. Any data recorded by a video event recorder shall be
6the sole property of the registered owner or lessee of the
7contract carrier vehicle.
