| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Lottery Law is amended by changing | 5 | | Section 21.5 as follows: | 6 | | (20 ILCS 1605/21.5)
| 7 | | Sec. 21.5. Carolyn Adams Ticket For The Cure. | 8 | | (a) The Department shall offer a special instant | 9 | | scratch-off game with the title of "Carolyn Adams Ticket For | 10 | | The Cure". The game shall commence on January 1, 2006 or as | 11 | | soon thereafter, in the discretion of the Director, as is | 12 | | reasonably practical, and shall be discontinued on December 31, | 13 | | 2026 2016 . The operation of the game shall be governed by this | 14 | | Act and any rules adopted by the Department. The Department | 15 | | must consult with the Carolyn Adams Ticket For The Cure Board, | 16 | | which is established under Section 2310-347 of the Department | 17 | | of Public Health Powers and Duties Law of the
Civil | 18 | | Administrative Code of Illinois, regarding the design and | 19 | | promotion of the game. If any provision of this Section is | 20 | | inconsistent with any other provision of this Act, then this | 21 | | Section governs. | 22 | | (b) The Carolyn Adams Ticket For The Cure Grant Fund is | 23 | | created as a special fund in the State treasury. The net |

| 1 | | revenue from the Carolyn Adams Ticket For The Cure special | 2 | | instant scratch-off game shall be deposited into the Fund for | 3 | | appropriation by the General Assembly solely to the Department | 4 | | of Public Health for the purpose of making grants to public or | 5 | | private entities in Illinois for the purpose of funding breast | 6 | | cancer research, and supportive services for breast cancer | 7 | | survivors and those impacted by breast cancer and breast cancer | 8 | | education. In awarding grants, the Department of Public Health | 9 | | shall consider criteria that includes, but is not limited to, | 10 | | projects and initiatives that address disparities in incidence | 11 | | and mortality rates of breast cancer, based on data from the | 12 | | Illinois Cancer Registry, and populations facing barriers to | 13 | | care. The Department of Public Health shall, before grants are | 14 | | awarded, provide copies of all grant applications to the | 15 | | Carolyn Adams Ticket For The Cure Board, receive and review the | 16 | | Board's recommendations and comments, and consult with the | 17 | | Board regarding the grants. For purposes of this Section, the | 18 | | term "research" includes, without limitation, expenditures to | 19 | | develop and advance the understanding, techniques, and | 20 | | modalities effective in the detection, prevention, screening, | 21 | | and treatment of breast cancer and may include clinical trials. | 22 | | The grant funds may not be used for institutional, | 23 | | organizational, or community-based overhead costs, indirect | 24 | | costs, or levies. | 25 | | Moneys received for the purposes of this Section, | 26 | | including, without limitation, net revenue from the special |

| 1 | | instant scratch-off game and gifts, grants, and awards from any | 2 | | public or private entity, must be deposited into the Fund. Any | 3 | | interest earned on moneys in the Fund must be deposited into | 4 | | the Fund. | 5 | | For purposes of this subsection, "net revenue" means the | 6 | | total amount for which tickets have been sold less the sum of | 7 | | the amount paid out in prizes and the actual administrative | 8 | | expenses of the Department solely related to the Ticket For The | 9 | | Cure game. | 10 | | (c) During the time that tickets are sold for the Carolyn | 11 | | Adams Ticket For The Cure game, the Department shall not | 12 | | unreasonably diminish the efforts devoted to marketing any | 13 | | other instant scratch-off lottery game. | 14 | | (d) The Department may adopt any rules necessary to | 15 | | implement and administer the provisions of this Section.

Civil Administrative Code of Illinois is | 20 | | amended by changing Section 2310-347 as follows: | 21 | | (20 ILCS 2310/2310-347)
| 22 | | Sec. 2310-347. The Carolyn Adams Ticket For The Cure Board. | 23 | | (a) The Carolyn Adams Ticket For The Cure Board is created | 24 | | as an advisory board within the Department. Until 30 days after |

| 1 | | the effective date of this amendatory Act of the 97th General | 2 | | Assembly, the Board may consist of 10 members as follows: 2 | 3 | | members appointed by the President of the Senate; 2 members | 4 | | appointed by the Minority Leader of the Senate; 2 members | 5 | | appointed by the Speaker of the House of Representatives; 2 | 6 | | members appointed by the Minority Leader of the House of | 7 | | Representatives; and 2 members appointed by the Governor with | 8 | | the advice and consent of the Senate, one of whom shall be | 9 | | designated as chair of the Board at the time of appointment. | 10 | | (a-5) Notwithstanding any provision of this Article to the | 11 | | contrary, the term of office of each current Board member ends | 12 | | 30 days after the effective date of this amendatory Act of the | 13 | | 97th General Assembly or when his or her successor is appointed | 14 | | and qualified, whichever occurs sooner. No later than 30 days | 15 | | after the effective date of this amendatory Act of the 97th | 16 | | General Assembly, the Board shall consist of 10 newly appointed | 17 | | members. Four of the Board members shall be members of the | 18 | | General Assembly and appointed as follows: one member appointed | 19 | | by the President of the Senate; one member appointed by the | 20 | | Minority Leader of the Senate; one member appointed by the | 21 | | Speaker of the House of Representatives; and one member | 22 | | appointed by the Minority Leader of the House of | 23 | | Representatives. | 24 | | Six of the Board members shall be appointed by the Director | 25 | | of the Department of Public Health, who shall designate one of | 26 | | these appointed members as chair of the Board at the time of |

| 1 | | his or her appointment. These 6 members appointed by the | 2 | | Director shall reflect the population with regard to ethnic, | 3 | | racial, and geographical composition and shall include the | 4 | | following individuals: one breast cancer survivor; one | 5 | | physician specializing in breast cancer or related medical | 6 | | issues; one breast cancer researcher; one representative from a | 7 | | breast cancer organization; one individual who operates a | 8 | | patient navigation program at a major hospital or health | 9 | | system; and one breast cancer professional that may include, | 10 | | but not be limited to, a genetics counselor, a social worker, a | 11 | | detain, an occupational therapist, or a nurse. | 12 | | A Board member whose term has expired may continue to serve | 13 | | until a successor is appointed. A Board member who is not a | 14 | | member of the General Assembly may serve 2 consecutive 3-year | 15 | | terms and shall not be reappointed for 3 years after the | 16 | | completion of those consecutive terms. | 17 | | (b) Board members shall serve without compensation but may | 18 | | be reimbursed for their reasonable travel expenses incurred in | 19 | | performing their duties from funds available for that purpose. | 20 | | The Department shall provide staff and administrative support | 21 | | services to the Board. | 22 | | (c) The Board may advise: | 23 | | (i) the Department of Revenue in designing and | 24 | | promoting the Carolyn Adams Ticket For The Cure special | 25 | | instant scratch-off lottery game; | 26 | | (ii) the Department in reviewing grant applications; |

| 1 | | and | 2 | | (iii) the Director on the final award of grants from | 3 | | amounts appropriated from the Carolyn Adams Ticket For The | 4 | | Cure Grant Fund, to public or private entities in Illinois | 5 | | that reflect the population with regard to ethnic, racial, | 6 | | and geographical composition for the purpose of funding | 7 | | breast cancer research and supportive services for breast | 8 | | cancer survivors and those impacted by breast cancer and | 9 | | breast cancer education. In awarding grants, the | 10 | | Department shall consider criteria that includes, but is | 11 | | not limited to, projects and initiatives that address | 12 | | disparities in incidence and mortality rates of breast | 13 | | cancer, based on data from the Illinois Cancer Registry, | 14 | | and populations facing barriers to care in accordance with | 15 | | Section 21.5 of the Illinois Lottery Law. | 16 | | (c-5) The Department shall submit a report to the Governor | 17 | | and the General Assembly by December 31 of each year. The | 18 | | report shall provide a summary of the Carolyn Adams Ticket for | 19 | | the Cure lottery ticket sales, grants awarded, and the | 20 | | accomplishments of the grantees. | 21 | | (d) The Board is discontinued on June 30, 2027 2017 .

| 23 | | Section 99. Effective date. This Act takes effect upon | 24 | | becoming law.
