| 2 | | AMENDMENT NO. ______. Amend Senate Bill 221 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Short title. This Act may be cited as the | 5 | | Political Events on College Campuses Act. | 6 | | Section 5. Definitions. In this Act: | 7 | | "Facility" includes all buildings and grounds owned or | 8 | | controlled by the public university or community college and | 9 | | the streets, sidewalks, malls, parking lots, and roadways | 10 | | within the boundaries of property owned or controlled by the | 11 | | public university or community college. | 12 | | "Use of facilities" means the holding of any event or | 13 | | forum, the posting of signs, all forms of advertising, | 14 | | commercial solicitation or the conduct of other commercial | 15 | | activities, and the distribution of pamphlets or similar | 16 | | written materials on or using public university or community |

| 1 | | college facilities.
| 2 | | Section 10. Facility priority. First priority for the use | 3 | | of campus facilities shall be given to regularly scheduled | 4 | | public university or community college activities. The use of | 5 | | public university or community college facilities may be | 6 | | subject to reasonable time, place, and manner restrictions that | 7 | | take into account, among other considerations, the general | 8 | | facilities policy, the direct and indirect costs to the public | 9 | | university or community college, environmental, health and | 10 | | safety concerns, wear and tear on the facilities, | 11 | | appropriateness of the event to the specific facility, and the | 12 | | impact of the event on the campus community, surrounding | 13 | | neighborhoods, and the general public. In reviewing | 14 | | conflicting requests to use public university or community | 15 | | college facilities, primary consideration shall be given to | 16 | | activities specifically related to the public university or | 17 | | community college's mission. | 18 | | Section 15. Political activities.
Public university and | 19 | | community college facilities may be used for political | 20 | | activities when that use complies with Section 5-15 of the | 21 | | State Officials and Employees Ethics Act. Examples of political | 22 | | activities may include: | 23 | | (1) public university and community college | 24 | | departments, student government organizations, or |

| 1 | | registered student organizations sponsoring candidate | 2 | | forums, voter registration drives, and issue forums | 3 | | regarding ballot propositions; | 4 | | (2) candidates for office and proponents or opponents | 5 | | of ballot propositions renting public university or | 6 | | community college facilities on a short-term basis for | 7 | | campaign purposes to the same extent and on the same basis | 8 | | as may other individuals or groups; | 9 | | (3) candidates for office and proponents or opponents | 10 | | of ballot propositions using public forum areas, to the | 11 | | same extent and on the same basis as may other individuals | 12 | | or groups; and | 13 | | (4) a registered student organization inviting a | 14 | | candidate or another political speaker to one of the | 15 | | meetings of its membership on public university or | 16 | | community college property, if the student organization | 17 | | has complied with the scheduling procedures of the public | 18 | | university or community college. | 19 | | Section 20. Restrictions. | 20 | | (a) When an event under this Act involves the rental of a | 21 | | public university or community college facility, the full | 22 | | rental cost of the facility must be paid and State funds may | 23 | | not be used to pay rental costs or cover any other costs | 24 | | associated with the event. | 25 | | (b) Public university or community college facilities may |

| 1 | | not be used to establish or maintain offices or headquarters | 2 | | for political candidates or partisan political causes. | 3 | | (c) All candidates who have filed for office for a given | 4 | | position, regardless of party affiliation, must be given equal | 5 | | access to the use of facilities within a reasonable time, if | 6 | | the candidates are in compliance with the provisions of this | 7 | | Act. | 8 | | (d) No person shall solicit contributions on public | 9 | | university or community college property for political uses, | 10 | | except in instances where this limitation conflicts with | 11 | | applicable federal law regarding interference with the mails. | 12 | | (e) Use of public university facilities for political | 13 | | activities, as described in this Act, must have prior approval | 14 | | of the university ethics and compliance office and the Office | 15 | | of the Vice Chancellor for Academic Affairs and Provost or a | 16 | | similar office. | 17 | | (f) Use of community college facilities for political | 18 | | activities, as described in this Act, must have prior approval | 19 | | of the campus human resources office or a designee set forth by | 20 | | the community college.".
