AMENDMENT TO SENATE BILL 37

2    AMENDMENT NO. ______. Amend Senate Bill 37 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Election Code is amended by adding Section
51A-50 as follows:
 
6    (10 ILCS 5/1A-50 new)
7    Sec. 1A-50. Municipal websites; election information. The
8State Board of Elections shall adopt rules under Section 1-9-10
9of the Illinois Municipal Code.
 
10    Section 10. The Illinois Municipal Code is amended by
11adding Section 1-9-10 as follows:
 
12    (65 ILCS 5/1-9-10 new)
13    Sec. 1-9-10. Municipal websites; election information.
14    (a) In the 6 months before an election, municipalities

1shall make available a section or page of their website for
2online local election information that includes candidates
3running for municipal, county, and State offices whose names
4will appear on the local ballot. This section or page shall
5include a list of the name of each registered candidate for
6each office. If a municipality does not have a website, it is
7not required to create one for the purposes of this Section.
8    (b) Candidates may submit the following for inclusion on
9the municipal websites:
10        (1) a photograph of the candidate;
11        (2) the candidate's contact information, not to exceed
12    100 characters for his or her choice of email, phone
13    number, or address of candidate;
14        (3) the candidate's party affiliation, not to exceed 50
15    characters;
16        (4) one website link;
17        (5) one video link; and
18        (6) up to 250 characters of other information about the
19    candidate.
20    (c) Any candidate providing information under subsection
21(b) of this Section shall submit for inclusion on the municipal
22websites a statement verifying that the information submitted
23is authentic.
24    (d) The municipality is not responsible for creating this
25content. If the candidate does not provide any information to a
26municipality, that municipality is only responsible for

1listing the name of each candidate to appear on the ballot. The
2municipality is not responsible for the editing or reformatting
3of any data provided by the candidate. Any municipality may, by
4ordinance or resolution, establish criteria for the submission
5and format of the information under subsection (b).
6    (e) Any municipality's local government access television
7station may also post this information on their channel to run
8during available air time in the months leading up to the
9election.
10    (f) The State Board of Elections shall adopt rules to
11enforce the provisions of this Section. Those rules shall be
12made public and posted on the State Board of Elections'
13website. Each municipality shall publish rules of access and
14page moderation on their website.".
