1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.875 as follows:
 
6    (30 ILCS 105/5.875 new)
7    Sec. 5.875. The Roadside Monarch Habitat Fund.
 
8    Section 10. The Illinois Vehicle Code is amended by
9changing Section 3-699.14 as follows:

13    Sec. 3-699.14. Universal special license plates.
14    (a) In addition to any other special license plate, the
15Secretary, upon receipt of all applicable fees and applications
16made in the form prescribed by the Secretary, may issue
17Universal special license plates to residents of Illinois on
18behalf of organizations that have been authorized by the
19General Assembly to issue decals for Universal special license
20plates. Appropriate documentation, as determined by the
21Secretary, shall accompany each application. Authorized

1organizations shall be designated by amendment to this Section.
2When applying for a Universal special license plate the
3applicant shall inform the Secretary of the name of the
4authorized organization from which the applicant will obtain a
5decal to place on the plate. The Secretary shall make a record
6of that organization and that organization shall remain
7affiliated with that plate until the plate is surrendered,
8revoked, or otherwise cancelled. The authorized organization
9may charge a fee to offset the cost of producing and
10distributing the decal, but that fee shall be retained by the
11authorized organization and shall be separate and distinct from
12any registration fees charged by the Secretary. No decal,
13sticker, or other material may be affixed to a Universal
14special license plate other than a decal authorized by the
15General Assembly in this Section or a registration renewal
16sticker. The special plates issued under this Section shall be
17affixed only to passenger vehicles of the first division,
18including motorcycles and autocycles, or motor vehicles of the
19second division weighing not more than 8,000 pounds. Plates
20issued under this Section shall expire according to the
21multi-year procedure under Section 3-414.1 of this Code.
22    (b) The design, color, and format of the Universal special
23license plate shall be wholly within the discretion of the
24Secretary. Universal special license plates are not required to
25designate "Land of Lincoln", as prescribed in subsection (b) of
26Section 3-412 of this Code. The design shall allow for the

1application of a decal to the plate. Organizations authorized
2by the General Assembly to issue decals for Universal special
3license plates shall comply with rules adopted by the Secretary
4governing the requirements for and approval of Universal
5special license plate decals. The Secretary may, in his or her
6discretion, allow Universal special license plates to be issued
7as vanity or personalized plates in accordance with Section
83-405.1 of this Code. The Secretary of State must make a
9version of the special registration plates authorized under
10this Section in a form appropriate for motorcycles and
11autocycles.
12    (c) When authorizing a Universal special license plate, the
13General Assembly shall set forth whether an additional fee is
14to be charged for the plate and, if a fee is to be charged, the
15amount of the fee and how the fee is to be distributed. When
16necessary, the authorizing language shall create a special fund
17in the State treasury into which fees may be deposited for an
18authorized Universal special license plate. Additional fees
19may only be charged if the fee is to be paid over to a State
20agency or to a charitable entity that is in compliance with the
21registration and reporting requirements of the Charitable
22Trust Act and the Solicitation for Charity Act. Any charitable
23entity receiving fees for the sale of Universal special license
24plates shall annually provide the Secretary of State a letter
25of compliance issued by the Attorney General verifying that the
26entity is in compliance with the Charitable Trust Act and the

1Solicitation for Charity Act.
2    (d) Upon original issuance and for each registration
3renewal period, in addition to the appropriate registration
4fee, if applicable, the Secretary shall collect any additional
5fees, if required, for issuance of Universal special license
6plates. The fees shall be collected on behalf of the
7organization designated by the applicant when applying for the
8plate. All fees collected shall be transferred to the State
9agency on whose behalf the fees were collected, or paid into
10the special fund designated in the law authorizing the
11organization to issue decals for Universal special license
12plates. All money in the designated fund shall be distributed
13by the Secretary subject to appropriation by the General
14Assembly.
15    (e) The following organizations may issue decals for
16Universal special license plates with the original and renewal
17fees and fee distribution as follows:
18        (1) The Illinois Department of Natural Resources.
19            (A) Original issuance: $25; with $10 to the
20        Roadside Monarch Habitat Fund and $15 to the Secretary
21        of State Special Plate Fund.
22            (B) Renewal: $25; with $23 to the Roadside Monarch
23        Habitat Fund and $2 to the Secretary of State Special
24        Plate Fund.
25    (f) The following funds are created as special funds in the
26State treasury:

1        (1) The Roadside Monarch Habitat Fund. All moneys to be
2    paid as grants to the Illinois Department of Natural
3    Resources to fund roadside monarch and other pollinator
4    habitat development, enhancement, and restoration projects
5    in this State.

7    Section 95. No acceleration or delay. Where this Act makes
8changes in a statute that is represented in this Act by text
9that is not yet or no longer in effect (for example, a Section
10represented by multiple versions), the use of that text does
11not accelerate or delay the taking effect of (i) the changes
12made by this Act or (ii) provisions derived from any other
13Public Act.
 
14    Section 99. Effective date. This Act takes effect upon
15becoming law.
