AMENDMENT TO HOUSE BILL 6128

2    AMENDMENT NO. ______. Amend House Bill 6128 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by changing Sections
521B-20 and 21B-30 as follows:
 
6    (105 ILCS 5/21B-20)
7    Sec. 21B-20. Types of licenses. Before July 1, 2013, the
8State Board of Education shall implement a system of educator
9licensure, whereby individuals employed in school districts
10who are required to be licensed must have one of the following
11licenses: (i) a professional educator license; (ii) a
12professional educator license with stipulations; or (iii) a
13substitute teaching license. References in law regarding
14individuals certified or certificated or required to be
15certified or certificated under Article 21 of this Code shall
16also include individuals licensed or required to be licensed

1under this Article. The first year of all licenses ends on June
230 following one full year of the license being issued.
3    The State Board of Education, in consultation with the
4State Educator Preparation and Licensure Board, may adopt such
5rules as may be necessary to govern the requirements for
6licenses and endorsements under this Section.
7        (1) Professional Educator License. Persons who (i)
8    have successfully completed an approved educator
9    preparation program and are recommended for licensure by
10    the Illinois institution offering the approved educator
11    preparation program in Illinois or a comparable
12    preparation program in another state, (ii) have
13    successfully completed the required testing under Section
14    21B-30 of this Code, including, for a first endorsement in
15    a teaching field, an evidence-based assessment of teacher
16    effectiveness, as set forth in Section 25.720 of Title 23
17    of the Illinois Administrative Code and approved by the
18    State Superintendent of Education in consultation with the
19    State Educator Preparation and Licensure Board, within the
20    first 2 years of employment as a teacher of record with an
21    Educator License with Stipulations, (iii) have
22    successfully completed coursework on the psychology of,
23    the identification of, and the methods of instruction for
24    the exceptional child, including without limitation
25    children with learning disabilities, (iv) have
26    successfully completed coursework in methods of reading

1    and reading in the content area, and (v) have met all other
2    criteria established by rule of the State Board of
3    Education shall be issued a Professional Educator License.
4    All Professional Educator Licenses are valid until June 30
5    immediately following 5 years of the license being issued.
6    The Professional Educator License shall be endorsed with
7    specific areas and grade levels in which the individual is
8    eligible to practice.
9        Individuals can receive subsequent endorsements on the
10    Professional Educator License. Subsequent endorsements
11    shall require a minimum of 24 semester hours of coursework
12    in the endorsement area, unless otherwise specified by
13    rule, and passage of the applicable content area test.
14        (2) Educator License with Stipulations. An Educator
15    License with Stipulations shall be issued to persons who
16    have satisfied the requirements for a Professional
17    Educator License under item (i) of paragraph (1) of this
18    Section but with an endorsement that limits the license
19    holder to one particular position or does not require
20    completion of an approved educator program or both. An
21    individual with an Educator License with Stipulations who
22    meets all the provisions of paragraph (1) of this Section,
23    including an evidence-based assessment of teacher
24    effectiveness within the first 2 years of employment as a
25    teacher of record, shall be issued a Professional Educator
26    License.

1        An individual with an Educator License with
2    Stipulations must not be employed by a school district or
3    any other entity to replace any presently employed teacher
4    who otherwise would not be replaced for any reason.
5        An Educator License with Stipulations may be issued
6    with the following endorsements:
7            (A) Provisional educator. A provisional educator
8        endorsement in a specific content area or areas on an
9        Educator License with Stipulations may be issued to an
10        applicant who holds an educator license with a minimum
11        of 15 semester hours in content coursework from another
12        state, U.S. territory, or foreign country and who, at
13        the time of applying for an Illinois license, does not
14        meet the minimum requirements under Section 21B-35 of
15        this Code, but does, at a minimum, meet the following
16        requirements:
17                (i) Holds the equivalent of a minimum of a
18            bachelor's degree, unless a master's degree is
19            required for the endorsement, from a regionally
20            accredited college or university or, for
21            individuals educated in a country other than the
22            United States, the equivalent of a minimum of a
23            bachelor's degree issued in the United States,
24            unless a master's degree is required for the
25            endorsement.
26                (ii) Has passed or passes a test of basic

1            skills and content area test, as required by
2            Section 21B-30 of this Code, prior to or within one
3            year after issuance of the provisional educator
4            endorsement on the Educator License with
5            Stipulations. If an individual who holds an
6            Educator License with Stipulations endorsed for
7            provisional educator has not passed a test of basic
8            skills and applicable content area test or tests
9            within one year after issuance of the endorsement,
10            the endorsement shall expire on June 30 following
11            one full year of the endorsement being issued. If
12            such an individual has passed the test of basic
13            skills and applicable content area test or tests
14            either prior to issuance of the endorsement or
15            within one year after issuance of the endorsement,
16            the endorsement is valid until June 30 immediately
17            following 2 years of the license being issued,
18            during which time any and all coursework
19            deficiencies must be met and any and all additional
20            testing requirements deficiencies must be met.
21        In addition, a provisional educator endorsement for
22        principals or superintendents may be issued if the
23        individual meets the requirements set forth in
24        subdivisions (1) and (3) of subsection (b-5) of Section
25        21B-35 of this Code. Applicants who have not been
26        entitled by an Illinois-approved educator preparation

1        program at an Illinois institution of higher education
2        shall not receive a provisional educator endorsement
3        if the person completed an alternative licensure
4        program in another state, unless the program has been
5        determined to be equivalent to Illinois program
6        requirements.
7            Notwithstanding any other requirements of this
8        Section, a service member or spouse of a service member
9        may obtain a Professional Educator License with
10        Stipulations, and a provisional educator endorsement
11        in a specific content area or areas, if he or she holds
12        a valid teaching certificate or license in good
13        standing from another state, meets the qualifications
14        of educators outlined in Section 21B-15 of this Code,
15        and has not engaged in any misconduct that would
16        prohibit an individual from obtaining a license
17        pursuant to Illinois law, including without limitation
18        any administrative rules of the State Board of
19        Education.
20            In this Section, "service member" means any person
21        who, at the time of application under this Section, is
22        an active duty member of the United States Armed Forces
23        or any reserve component of the United States Armed
24        Forces or the National Guard of any state,
25        commonwealth, or territory of the United States or the
26        District of Columbia.

1            A provisional educator endorsement is valid until
2        June 30 immediately following 2 years of the license
3        being issued, provided that any remaining testing and
4        coursework deficiencies are met as set forth in this
5        Section. Failure to satisfy all stated deficiencies
6        shall mean the individual, including any service
7        member or spouse who has obtained a Professional
8        Educator License with Stipulations and a provisional
9        educator endorsement in a specific content area or
10        areas, is ineligible to receive a Professional
11        Educator License at that time. An Educator License with
12        Stipulations endorsed for provisional educator shall
13        not be renewed for individuals who hold an Educator
14        License with Stipulations and who have held a position
15        in a public school or non-public school recognized by
16        the State Board of Education.
17            (B) Alternative provisional educator. An
18        alternative provisional educator endorsement on an
19        Educator License with Stipulations may be issued to an
20        applicant who, at the time of applying for the
21        endorsement, has done all of the following:
22                (i) Graduated from a regionally accredited
23            college or university with a minimum of a
24            bachelor's degree.
25                (ii) Successfully completed the first phase of
26            the Alternative Educator Licensure Program for

1            Teachers, as described in Section 21B-50 of this
2            Code.
3                (iii) Passed a test of basic skills and content
4            area test, as required under Section 21B-30 of this
5            Code.
6            The alternative provisional educator endorsement
7        is valid for 2 years of teaching and may be renewed for
8        a third year by an individual meeting the requirements
9        set forth in Section 21B-50 of this Code.
10            (C) Alternative provisional superintendent. An
11        alternative provisional superintendent endorsement on
12        an Educator License with Stipulations entitles the
13        holder to serve only as a superintendent or assistant
14        superintendent in a school district's central office.
15        This endorsement may only be issued to an applicant
16        who, at the time of applying for the endorsement, has
17        done all of the following:
18                (i) Graduated from a regionally accredited
19            college or university with a minimum of a master's
20            degree in a management field other than education.
21                (ii) Been employed for a period of at least 5
22            years in a management level position in a field
23            other than education.
24                (iii) Successfully completed the first phase
25            of an alternative route to superintendent
26            endorsement program, as provided in Section 21B-55

1            of this Code.
2                (iv) Passed a test of basic skills and content
3            area tests required under Section 21B-30 of this
4            Code.
5            The endorsement may be registered for 2 fiscal
6        years in order to complete one full year of serving as
7        a superintendent or assistant superintendent.
8            (D) Resident teacher endorsement. A resident
9        teacher endorsement on an Educator License with
10        Stipulations may be issued to an applicant who, at the
11        time of applying for the endorsement, has done all of
12        the following:
13                (i) Graduated from a regionally accredited
14            institution of higher education with a minimum of a
15            bachelor's degree.
16                (ii) Enrolled in an approved Illinois educator
17            preparation program.
18                (iii) Passed a test of basic skills and content
19            area test, as required under Section 21B-30 of this
20            Code.
21            The resident teacher endorsement on an Educator
22        License with Stipulations is valid for 4 years of
23        teaching and shall not be renewed.
24            A resident teacher may teach only under the
25        direction of a licensed teacher, who shall act as the
26        resident mentor teacher, and may not teach in place of

1        a licensed teacher. A resident teacher endorsement on
2        an Educator License with Stipulations shall no longer
3        be valid after June 30, 2017.
4            (E) Career and technical educator. A career and
5        technical educator endorsement on an Educator License
6        with Stipulations may be issued to an applicant who has
7        a minimum of 60 semester hours of coursework from a
8        regionally accredited institution of higher education
9        and has a minimum of 2,000 hours of experience outside
10        of education in each area to be taught.
11            The career and technical educator endorsement on
12        an Educator License with Stipulations is valid until
13        June 30 immediately following 5 years of the
14        endorsement being issued and may be renewed. For
15        individuals who were issued the career and technical
16        educator endorsement on an Educator License with
17        Stipulations on or after January 1, 2015, the license
18        may be renewed if the individual passes a test of basic
19        skills, as required under Section 21B-30 of this Code.
20            (F) Part-time provisional career and technical
21        educator or provisional career and technical educator.
22        A part-time provisional career and technical educator
23        endorsement or a provisional career and technical
24        educator endorsement on an Educator License with
25        Stipulations may be issued to an applicant who has a
26        minimum of 8,000 hours of work experience in the skill

1        for which the applicant is seeking the endorsement. It
2        is the responsibility of each employing school board
3        and regional office of education to provide
4        verification, in writing, to the State Superintendent
5        of Education at the time the application is submitted
6        that no qualified teacher holding a Professional
7        Educator License or an Educator License with
8        Stipulations with a career and technical educator
9        endorsement is available and that actual circumstances
10        require such issuance.
11            The provisional career and technical educator
12        endorsement on an Educator License with Stipulations
13        is valid until June 30 immediately following 5 years of
14        the endorsement being issued and may be renewed only
15        one time for 5 years. For individuals who were issued
16        the provisional career and technical educator
17        endorsement on an Educator License with Stipulations
18        on or after January 1, 2015, the license may be renewed
19        one time if the individual passes a test of basic
20        skills, as required under Section 21B-30 of this Code,
21        and has completed a minimum of 20 semester hours from a
22        regionally accredited institution.
23            A part-time provisional career and technical
24        educator endorsement on an Educator License with
25        Stipulations may be issued for teaching no more than 2
26        courses of study for grades 6 through 12. The part-time

1        provisional career and technical educator endorsement
2        on an Educator License with Stipulations is valid until
3        June 30 immediately following 5 years of the
4        endorsement being issued and may be renewed for 5 years
5        if the individual makes application for renewal.
6            (G) Transitional bilingual educator. A
7        transitional bilingual educator endorsement on an
8        Educator License with Stipulations may be issued for
9        the purpose of providing instruction in accordance
10        with Article 14C of this Code to an applicant who
11        provides satisfactory evidence that he or she meets all
12        of the following requirements:
13                (i) Possesses adequate speaking, reading, and
14            writing ability in the language other than English
15            in which transitional bilingual education is
16            offered.
17                (ii) Has the ability to successfully
18            communicate in English.
19                (iii) Either possessed, within 5 years
20            previous to his or her applying for a transitional
21            bilingual educator endorsement, a valid and
22            comparable teaching certificate or comparable
23            authorization issued by a foreign country or holds
24            a degree from an institution of higher learning in
25            a foreign country that the State Educator
26            Preparation and Licensure Board determines to be

1            the equivalent of a bachelor's degree from a
2            regionally accredited institution of higher
3            learning in the United States.
4            A transitional bilingual educator endorsement
5        shall be valid for prekindergarten through grade 12, is
6        valid until June 30 immediately following 5 years of
7        the endorsement being issued, and shall not be renewed.
8            Persons holding a transitional bilingual educator
9        endorsement shall not be employed to replace any
10        presently employed teacher who otherwise would not be
11        replaced for any reason.
12            (H) Language endorsement. In an effort to
13        alleviate the shortage of teachers speaking a language
14        other than English in the public schools, an individual
15        who holds an Educator License with Stipulations may
16        also apply for a language endorsement, provided that
17        the applicant provides satisfactory evidence that he
18        or she meets all of the following requirements:
19                (i) Holds a transitional bilingual
20            endorsement.
21                (ii) Has demonstrated proficiency in the
22            language for which the endorsement is to be issued
23            by passing the applicable language content test
24            required by the State Board of Education.
25                (iii) Holds a bachelor's degree or higher from
26            a regionally accredited institution of higher

1            education or, for individuals educated in a
2            country other than the United States, holds a
3            degree from an institution of higher learning in a
4            foreign country that the State Educator
5            Preparation and Licensure Board determines to be
6            the equivalent of a bachelor's degree from a
7            regionally accredited institution of higher
8            learning in the United States.
9                (iv) Has passed a test of basic skills, as
10            required under Section 21B-30 of this Code.
11            A language endorsement on an Educator License with
12        Stipulations is valid for prekindergarten through
13        grade 12 for the same validity period as the
14        individual's transitional bilingual educator
15        endorsement on the Educator License with Stipulations
16        and shall not be renewed.
17            (I) Visiting international educator. A visiting
18        international educator endorsement on an Educator
19        License with Stipulations may be issued to an
20        individual who is being recruited by a particular
21        school district that conducts formal recruitment
22        programs outside of the United States to secure the
23        services of qualified teachers and who meets all of the
24        following requirements:
25                (i) Holds the equivalent of a minimum of a
26            bachelor's degree issued in the United States.

1                (ii) Has been prepared as a teacher at the
2            grade level for which he or she will be employed.
3                (iii) Has adequate content knowledge in the
4            subject to be taught.
5                (iv) Has an adequate command of the English
6            language.
7            A holder of a visiting international educator
8        endorsement on an Educator License with Stipulations
9        shall be permitted to teach in bilingual education
10        programs in the language that was the medium of
11        instruction in his or her teacher preparation program,
12        provided that he or she passes the English Language
13        Proficiency Examination or another test of writing
14        skills in English identified by the State Board of
15        Education, in consultation with the State Educator
16        Preparation and Licensure Board.
17            A visiting international educator endorsement on
18        an Educator License with Stipulations is valid for 3
19        years and shall not be renewed.
20            (J) Paraprofessional educator. A paraprofessional
21        educator endorsement on an Educator License with
22        Stipulations may be issued to an applicant who holds a
23        high school diploma or its recognized equivalent and
24        either holds an associate's degree or a minimum of 60
25        semester hours of credit from a regionally accredited
26        institution of higher education or has passed a test of

1        basic skills required under Section 21B-30 of this
2        Code. The paraprofessional educator endorsement is
3        valid until June 30 immediately following 5 years of
4        the endorsement being issued and may be renewed through
5        application and payment of the appropriate fee, as
6        required under Section 21B-40 of this Code. An
7        individual who holds only a paraprofessional educator
8        endorsement is not subject to additional requirements
9        in order to renew the endorsement.
10            (K) Chief school business official. A chief school
11        business official endorsement on an Educator License
12        with Stipulations may be issued to an applicant who
13        qualifies by having a master's degree or higher, 2
14        years of full-time administrative experience in school
15        business management or 2 years of university-approved
16        practical experience, and a minimum of 24 semester
17        hours of graduate credit in a program approved by the
18        State Board of Education for the preparation of school
19        business administrators and by passage of the
20        applicable State tests, including a test of basic
21        skills and applicable content area test.
22            The chief school business official endorsement may
23        also be affixed to the Educator License with
24        Stipulations of any holder who qualifies by having a
25        master's degree in business administration, finance,
26        or accounting and who completes an additional 6

1        semester hours of internship in school business
2        management from a regionally accredited institution of
3        higher education and passes the applicable State
4        tests, including a test of basic skills and applicable
5        content area test. This endorsement shall be required
6        for any individual employed as a chief school business
7        official.
8            The chief school business official endorsement on
9        an Educator License with Stipulations is valid until
10        June 30 immediately following 5 years of the
11        endorsement being issued and may be renewed if the
12        license holder completes renewal requirements as
13        required for individuals who hold a Professional
14        Educator License endorsed for chief school business
15        official under Section 21B-45 of this Code and such
16        rules as may be adopted by the State Board of
17        Education.
18        (3) Substitute Teaching License. A Substitute Teaching
19    License may be issued to qualified applicants for
20    substitute teaching in all grades of the public schools,
21    prekindergarten through grade 12. Substitute Teaching
22    Licenses are not eligible for endorsements. Applicants for
23    a Substitute Teaching License must hold a bachelor's degree
24    or higher from a regionally accredited institution of
25    higher education.
26        Substitute Teaching Licenses are valid for 5 years and

1    may be renewed if the individual has passed a test of basic
2    skills, as authorized under Section 21B-30 of this Code. An
3    individual who has passed a test of basic skills for the
4    first licensure renewal is not required to retake the test
5    again for further renewals.
6        Substitute Teaching Licenses are valid for substitute
7    teaching in every county of this State. If an individual
8    has had his or her Professional Educator License or
9    Educator License with Stipulations suspended or revoked or
10    has not met the renewal requirements for licensure, then
11    that individual is not eligible to obtain a Substitute
12    Teaching License.
13        A substitute teacher may only teach in the place of a
14    licensed teacher who is under contract with the employing
15    board. If, however, there is no licensed teacher under
16    contract because of an emergency situation, then a district
17    may employ a substitute teacher for no longer than 30
18    calendar days per each vacant position in the district if
19    the district notifies the appropriate regional office of
20    education within 5 business days after the employment of
21    the substitute teacher in the emergency situation. An
22    emergency situation is one in which an unforeseen vacancy
23    has occurred and (i) a teacher is unable to fulfill his or
24    her contractual duties or (ii) teacher capacity needs of
25    the district exceed previous indications, and the district
26    is actively engaged in advertising to hire a fully licensed

1    teacher for the vacant position.
2        There is no limit on the number of days that a
3    substitute teacher may teach in a single school district,
4    provided that no substitute teacher may teach for longer
5    than 90 school days for any one licensed teacher under
6    contract in the same school year. A substitute teacher who
7    holds a Professional Educator License or Educator License
8    with Stipulations shall not teach for more than 120 school
9    days for any one licensed teacher under contract in the
10    same school year. The limitations in this paragraph (3) on
11    the number of days a substitute teacher may be employed do
12    not apply to any school district operating under Article 34
13    of this Code.

17    (105 ILCS 5/21B-30)
18    Sec. 21B-30. Educator testing.
19    (a) This Section applies beginning on July 1, 2012.
20    (b) The State Board of Education, in consultation with the
21State Educator Preparation and Licensure Board, shall design
22and implement a system of examinations, which shall be required
23prior to the issuance of educator licenses. These examinations
24and indicators must be based on national and State professional
25teaching standards, as determined by the State Board of

1Education, in consultation with the State Educator Preparation
2and Licensure Board. The State Board of Education may adopt
3such rules as may be necessary to implement and administer this
4Section. No score on a test required under this Section, other
5than a test of basic skills, shall be more than 10 years old at
6the time that an individual makes application for an educator
7license or endorsement.
8    (c) Applicants seeking a Professional Educator License or
9an Educator License with Stipulations shall be required to pass
10a test of basic skills before the license is issued, unless the
11endorsement the individual is seeking does not require passage
12of the test. All applicants completing Illinois-approved,
13teacher education or school service personnel preparation
14programs shall be required to pass the State Board of
15Education's recognized test of basic skills prior to starting
16their student teaching or starting the final semester of their
17internship, unless required earlier at the discretion of the
18recognized, Illinois institution in which they are completing
19their approved program. An individual who passes a test of
20basic skills does not need to do so again for subsequent
21endorsements or other educator licenses.
22    (d) All applicants seeking a State license shall be
23required to pass a test of content area knowledge for each area
24of endorsement for which there is an applicable test. There
25shall be no exception to this requirement. No candidate shall
26be allowed to student teach or serve as the teacher of record

1until he or she has passed the applicable content area test.
2    (e) All applicants seeking a State license endorsed in a
3teaching field shall pass the assessment of professional
4teaching (APT). Passage of the APT is required for completion
5of an approved Illinois educator preparation program.
6    (f) All Beginning on September 1, 2015, all candidates
7completing teacher preparation programs in this State or
8out-of-state and all candidates subject to Section 21B-35 of
9this Code are required to pass, within the first 2 years of
10employment as a teacher of record with an Educator License with
11Stipulations, an evidence-based assessment of teacher
12effectiveness approved by the State Board of Education, in
13consultation with the State Educator Preparation and Licensure
14Board. All recognized institutions offering approved teacher
15preparation programs must begin phasing in the approved teacher
16performance assessment no later than July 1, 2013.
17    (g) Tests of basic skills and content area knowledge and
18the assessment of professional teaching shall be the tests that
19from time to time are designated by the State Board of
20Education, in consultation with the State Educator Preparation
21and Licensure Board, and may be tests prepared by an
22educational testing organization or tests designed by the State
23Board of Education, in consultation with the State Educator
24Preparation and Licensure Board. The areas to be covered by a
25test of basic skills shall include reading, language arts, and
26mathematics. The test of content area knowledge shall assess

1content knowledge in a specific subject field. The tests must
2be designed to be racially neutral to ensure that no person
3taking the tests is discriminated against on the basis of race,
4color, national origin, or other factors unrelated to the
5person's ability to perform as a licensed employee. The score
6required to pass the tests shall be fixed by the State Board of
7Education, in consultation with the State Educator Preparation
8and Licensure Board. The tests shall be administered not fewer
9than 3 times a year at such time and place as may be designated
10by the State Board of Education, in consultation with the State
11Educator Preparation and Licensure Board.
12    The State Board shall implement a test or tests to assess
13the speaking, reading, writing, and grammar skills of
14applicants for an endorsement or a license issued under
15subdivision (G) of paragraph (2) of Section 21B-20 of this Code
16in the English language and in the language of the transitional
17bilingual education program requested by the applicant.
18    (h) Except as provided in Section 34-6 of this Code, the
19provisions of this Section shall apply equally in any school
20district subject to Article 34 of this Code.
21    (i) The rules developed to implement and enforce the
22testing requirements under this Section shall include without
23limitation provisions governing test selection, test
24validation and determination of a passing score,
25administration of the tests, frequency of administration,
26applicant fees, frequency of applicants taking the tests, the

1years for which a score is valid, and appropriate special
2accommodations. The State Board of Education shall develop such
3rules as may be needed to ensure uniformity from year to year
4in the level of difficulty for each form of an assessment.

7    Section 99. Effective date. This Act takes effect upon
8becoming law.".
