AMENDMENT TO HOUSE BILL 4682

2    AMENDMENT NO. ______. Amend House Bill 4682 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Massage Licensing Act is amended by adding
5Section 18 and by changing Section 32 as follows:
 
6    (225 ILCS 57/18 new)
7    Sec. 18. Forged or altered massage therapist license.
8    (a) Any person who forges or alters a massage therapist
9license commits a Class 2 felony.
10    (b) Any person who knowingly possesses a forged or altered
11massage therapist license with the intent to use it commits a
12Class 2 felony. A person who possesses a massage therapist
13license with knowledge that it is forged or altered commits a
14Class 2 felony.
15    (c) Whoever knowingly aids, abets, assists, procures,
16advises, employs, or contracts with any person who knowingly

1possesses a forged or altered massage therapist license with
2the intent to use it commits a Class 2 felony.

4    (Section scheduled to be repealed on January 1, 2022)
5    Sec. 32. Display.
6    (a) Every holder of a license shall display it, or a copy,
7in a conspicuous place in the holder's principal office or any
8other location where the holder renders massage therapy
9services.
10    (b) Every holder of a license issued under Section 18 of
11this Act shall display it, or a copy, in a conspicuous place in
12the holder's principal office or any other location where the
13holder renders massage therapy services after receiving the
14license from the Department.
15    (c) Any person who practices his or her profession under
16this Act without having in his or her possession a massage
17therapist license issued in his or her name by the Department
18under the provisions of this Act commits a Class 2 felony.

20    Section 10. The Barber, Cosmetology, Esthetics, Hair
21Braiding, and Nail Technology Act of 1985 is amended by
22changing Section 1-10 and adding Section 3C-11 as follows:

1    (Section scheduled to be repealed on January 1, 2026)
2    Sec. 1-10. Display.
3    (a) Every holder of a license shall display it in a place
4in the holder's principal office, place of business or place of
5employment. Whenever a licensed cosmetologist, esthetician,
6nail technician, hair braider, or barber practices
7cosmetology, esthetics, nail technology, hair braiding, or
8barbering outside of or away from the cosmetologist's,
9esthetician's, nail technician's, hair braider's, or barber's
10principal office, place of business, or place of employment,
11the cosmetologist, esthetician, nail technician, hair braider,
12or barber shall provide any person so requesting proof that he
13or she has a valid license issued by the Department.
14    Every registered shop shall display its certificate of
15registration at the location of the shop. Each shop where
16barber, cosmetology, esthetics, hair braiding, or nail
17technology services are provided shall have a certificate of
18registration.
19    (b) Every holder of a nail technician license issued under
20Section 3C-11 of this Act shall display it, or a copy, in a
21conspicuous place in the holder's principal office or any other
22location where the holder renders nail technician services
23after receiving the license from the Department.
24    (c) Any person who practices his or her profession under
25this Act without having in his or her possession a nail
26technician license issued in his or her name by the Department

1under the provisions of this Act commits a Class 2 felony.

4    Sec. 3C-11. Forged or altered nail technician licenses.
5    (a) Any person who forges or alters a nail technician
6license commits a Class 2 felony.
7    (b) Any person who knowingly possesses a forged or altered
8nail technician license with the intent to use it commits a
9Class 2 felony. A person who possesses a nail technician
10license with knowledge that it is forged or altered commits a
11Class 2 felony.
12    (c) Whoever knowingly aids, abets, assists, procures,
13advises, employs, or contracts with any person who knowingly
14possesses a forged or altered nail technician license with the
15intent to use it commits a Class 2 felony.
 
16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
