625 ILCS 5/6-103.1

    Amends the Illinois Vehicle Code. Provides for the issuance of a driver's license to a nonresident who becomes a resident of this State for 10 or more consecutive years while that person's driving privileges are revoked in another State.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 6-103.1 as follows:
 
6    (625 ILCS 5/6-103.1)
7    Sec. 6-103.1. New residents; out-of-state revocation.
8    (a) The Secretary of State may not issue a driver's license
9to a nonresident who becomes a resident of this State while the
10new resident's driving privileges are revoked, under terms
11similar to those provided in Section 1-176 of this Code, in
12another state; however, if the person has resided in this State
13for 10 or more consecutive years prior to submitting an
14application, that person may apply for licensure under Section
156-208 of this Code if:
16        (1) the laws of the revoking state would allow the
17    person to apply for licensure in that state;
18        (2) the person qualifies to apply for licensure under
19    Section 6-208;
20        (3) the out-of-state revocation is the only revocation
21    of driving privileges for the person;
22        (4) the person has not had any driving offenses since
23    the revocation, and the revocation is the only loss of the

1    person's driving privileges in any jurisdiction; and
2        (5) the person complies with the requirements of Title
3    92, Section 1001.430 of the Illinois Administrative Code
4    concerning the General Provisions for Reinstatement of
5    Driving Privileges After Revocation.
6    (b) The Secretary may issue restricted driving permits to
7new residents whose driving privileges are revoked in another
8state. These permits must be issued according to the
9restrictions, and for the purposes, stated in Sections 6-205
10and 6-206 of this Code. The Secretary shall adopt rules for the
11issuance of these permits.
12    (c) A restricted driving permit issued under this Section
13is subject to cancellation, revocation, and suspension by the
14Secretary of State in the same manner and for the same causes
15as a driver's license issued under this Code may be cancelled,
16revoked, or suspended, except that a conviction of one or more
17offenses against laws or ordinances regulating the movement of
18traffic is sufficient cause for the revocation, suspension, or
19cancellation of a restricted driving permit.
