AMENDMENT TO HOUSE BILL 3887

2    AMENDMENT NO. ______. Amend House Bill 3887 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Business Assistance and Regulatory Reform
5Act is amended by adding Section 20 as follows:
 
6    (20 ILCS 608/20 new)
7    Sec. 20. Review of rules and regulations; reporting.
8    (a) As used in this Section:
9    "Small business" means a corporation or a concern,
10including its affiliates, that is independently owned and
11operated, not dominant in its field, and employs fewer than 50
12full-time employees or has gross annual sales of less than
13$4,000,000. For purposes of a specific rule, an agency may
14define small business to include employment of 50 or more
15persons if it finds that such a definition is necessary to
16adapt the rule to the needs and problems of small businesses

1and organizations.
2    "State agencies" means all officers, boards, commissions,
3and agencies of the executive branch, including all officers,
4departments, boards, commissions, agencies, institutions,
5authorities, universities, and bodies politic and corporate
6thereof; and administrative units or corporate outgrowths of
7the State government which are created by or pursuant to
8statute, other than units of local government and their
9officers, school districts and boards of election
10commissioners; all administrative units and corporate
11outgrowths of the above and as may be created by executive
12order of the Governor.
13    (b) Each State agency shall scrutinize its rules,
14administrative regulations, and permitting processes as they
15pertain to small businesses in order to identify those rules,
16regulations, and processes that are unreasonable, unduly
17burdensome, duplicative, or onerous to small businesses. The
18goal of this review is for each State agency to:
19        (1) recommend changes that will lessen the reporting
20    and paper work requirements on small businesses while still
21    achieving the intent of the underlying statute;
22        (2) eliminate unnecessary or antiquated permit
23    requirements;
24        (3) consolidate duplicative or overlapping permit
25    requirements;
26        (4) simplify overly complex or lengthy application

1    procedures; and
2        (5) expedite time-consuming agency review and approval
3    procedures.
4    (c) Each State agency must conduct its initial review of
5its rules, regulations, and permitting processes under
6subsection (b) of this Section within one year of the effective
7date of this amendatory Act of the 99th General Assembly, and
8every 5 years thereafter. At the conclusion of each review,
9each State agency must issue a report containing the results
10from its review and any recommendations to the Office of
11Business Permits and Regulatory Assistance, the Governor, and
12the General Assembly. ".
