1    AN ACT concerning employment.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Wage Payment and Collection Act is
5amended by adding Section 11.5 as follows:
 
6    (820 ILCS 115/11.5 new)
7    Sec. 11.5. Departmental wage recovery; remittance to
8aggrieved employee.
9    (a) Upon the recovery of unpaid wages, wage supplements, or
10final compensation from an employer that has violated this Act,
11the Department shall conduct a good faith search to find the
12aggrieved employee and to remit to the aggrieved employee the
13amount recovered no later than 120 days after the recovery. If
14after conducting a good faith search for the aggrieved employee
15the Department is unable to find the aggrieved employee, the
16Department shall deposit the amount recovered into the
17Department of Labor Special State Trust Fund on the first
18business day after 120 days after the recovery.
19    (b) An aggrieved employee may file a claim to recover
20unpaid wages, wage supplements, or final compensation that has
21been deposited into the Department of Labor Trust Fund. For the
22purpose of paying claims under this Section from the Department
23of Labor Special State Trust Fund to aggrieved employees, the

1Comptroller shall assign a vendor payment number to the
2Department. When an aggrieved employee presents a claim to the
3Department, the Department shall use the vendor payment number
4to process payment on the behalf of the aggrieved employee.
