AMENDMENT TO HOUSE BILL 3323

2    AMENDMENT NO. ______. Amend House Bill 3323 by replacing
3line 8 on page 1 through line 7 on page 2 with the following:
 
4    "(a) The Agency shall adopt rules governing certain
5corrosion prevention projects carried out on community water
6supplies. Those rules shall not apply to buried pipelines
7including, but not limited to, pipes, mains, and joints. The
8rules shall exclude routine maintenance activities of
9community water supplies including, but not limited to, the use
10of protective coatings applied by the owner's utility personnel
11during the course of performing routine maintenance
12activities. The activities may include, but not be limited to,
13the painting of fire hydrants; routine over-coat painting of
14interior and exterior building surfaces such as floors, doors,
15windows, and ceilings; and routine touch-up and over-coat
16application of paint products typically found on water utility
17pumps, pipes, tanks, and other water treatment plant

1appurtenances and utility owned structures. Those rules shall
2include:
3        (1) standards for ensuring that community water
4    supplies carry out corrosion prevention and mitigation
5    methods according to corrosion prevention industry
6    standards adopted by the Agency;
7        (2) requirements that community water supplies use
8    industry trained and certified:
9            (A) protective coatings personnel to carry out
10        corrosion prevention and mitigation methods on any
11        type of substrate or surface, including, but not
12        limited to, concrete and steel tanks; water treatment
13        pipe galleys; doors; walls; ceilings; grating;
14        interior and exterior cabinets related to controls,
15        pumps, and generators; or any other water treatment
16        appurtenances where protective coatings are utilized
17        for corrosion control and prevention to prolong the
18        life of the water utility asset; and
19            (B) inspectors to ensure that best practices and
20        standards are adhered to on each corrosion prevention
21        project; and
22        (3) standards to prevent environmental degradation
23    that might occur as a result of carrying out corrosion
24    prevention and mitigation methods, including, but not
25    limited to, standards to prevent the improper handling and
26    containment of hazardous materials, especially lead paint,

1    removed from the exterior of a community water supply;";
2    and
 
3by replacing line 11 on page 4 through line 4 on page 7 with the
4following:
 
5    "(a) The Department may adopt rules governing all corrosion
6prevention projects carried out on eligible bridges. Rules may
7include a process for ensuring that corrosion prevention and
8mitigation methods are carried out according to corrosion
9prevention industry standards adopted by the Department for
10eligible bridges that include:
11        (1) the use of industry trained and certified personnel
12    as required by the Illinois Procurement Code;
13        (2) a plan to prevent environmental degradation that
14    could occur as a result of carrying out corrosion
15    prevention and mitigation methods including the careful
16    handling and containment of hazardous materials,
17    especially lead paint; and
18        (3) consulting and interacting directly with, for the
19    purpose of utilizing industry trained and certified
20    personnel, corrosion industry experts specializing in the
21    design and inspection of corrosion prevention and
22    mitigation methods on bridges containing lead-based or
23    other hazardous coatings.
24    (b) In this Section:

1        "Corrosion" means a naturally occurring phenomenon
2    commonly defined as the deterioration of a material
3    (usually a metal) that results from a chemical or
4    electrochemical reaction with its environment.
5        "Corrosion prevention and mitigation methods" means:
6            (1) the preparation, application, installation,
7        removal, or general maintenance as necessary of a
8        protective coating system including the following:
9                (A) surface preparation and coating
10            application on an eligible bridge;
11                (B) removal of a lead-based or other hazardous
12            coating from an eligible bridge; or
13                (C) shop painting of structural steel
14            fabricated for installation as part of an eligible
15            bridge; and
16            (2) any other activities related to corrosion
17        prevention, such as cathodic protection, on eligible
18        bridges determined by the Department that require
19        industry trained and certified personnel to carry out.
20        "Corrosion prevention project" means carrying out
21    corrosion prevention and mitigation methods during
22    construction, alteration, maintenance, repair work, or at
23    any other time necessary on an eligible bridge.
24        "Eligible bridge" means a bridge or overpass the
25    construction, alteration, maintenance, or repair work on
26    which is funded by the State.".
