AMENDMENT TO HOUSE BILL 3323

2    AMENDMENT NO. ______. Amend House Bill 3323 on page 1 by
3replacing lines 6 through 23 with the following:
 
4    "(415 ILCS 5/14.7 new)
5    Sec. 14.7. Preservation of community water supplies.
6    (a) The Agency shall adopt rules governing all corrosion
7prevention projects carried out on community water supplies.
8Those rules shall include:
9        (1) standards for ensuring that community water
10    supplies carry out corrosion prevention and mitigation
11    methods according to corrosion prevention industry
12    standards adopted by the Agency;
13        (2) requirements that community water supplies use
14    industry trained and certified:
15            (A) protective coatings personnel to carry out
16        corrosion prevention and mitigation methods on any
17        type of substrate or surface, including, but not

1        limited to, concrete and steel; and
2            (B) inspectors to ensure that best practices and
3        standards are adhered to on each corrosion prevention
4        project; and
5        (3) standards to prevent environmental degradation
6    that might occur as a result of carrying out corrosion
7    prevention and mitigation methods, including, but not
8    limited to, standards to prevent the improper handling and
9    containment of hazardous materials, especially lead paint,
10    removed from the interior or exterior of a community water
11    supply;
12    In adopting rules under this subsection (a), the Agency
13shall obtain input from corrosion industry experts
14specializing in the training and certification of personnel to
15carry out corrosion prevention and mitigation methods.
16    (b) As used in this Section:
17    "Community water supply" has the meaning ascribed to that
18term in Section 3.145 of this Act.
19    "Corrosion" means a naturally occurring phenomenon
20commonly defined as the deterioration of a material (usually a
21metal) that results from a chemical or electrochemical reaction
22with its environment.
23    "Corrosion prevention and mitigation methods" means:
24        (1) the preparation, application, installation,
25    removal, or general maintenance as necessary of a
26    protective coating system, including any or more of the

1    following:
2            (A) surface preparation and coating application on
3        the exterior or interior of a community water supply;
4            (B) removal of a lead-based or other hazardous
5        coating from a community water supply;
6            (C) shop painting of structural steel fabricated
7        for installation as part of a community water supply;
8        or
9            (D) installation of any polymer coating or
10        surfacing on any concrete, or other cementitious
11        substrate, that is a part of a community water supply;
12        and
13        (2) any other activities that are (i) related to
14    corrosion prevention, such as cathodic protection, of a
15    community water supply and (ii) determined by the Agency to
16    require industry trained and certified personnel to carry
17    out.
18    "Corrosion prevention project" means carrying out
19corrosion prevention and mitigation methods.
20    "Industry trained and certified" means having
21documentation that is recognized by the United States
22Department of Labor and that shows either:
23        (1) an individual's prior completion of, or current
24    enrollment in for at least the entire duration of a
25    corrosion prevention project on the community water
26    supply, a United States Department of Labor certified

1    apprenticeship training program that requires concurrent
2    on-the-job training and classroom instruction for an
3    individual to be considered adequately knowledgeable to
4    carry out corrosion prevention and mitigation methods; or
5        (2) an individual's receipt from a corrosion
6    prevention industry credentialing organization, whose
7    standards for corrosion prevention and mitigation methods
8    are recognized by the Agency, of confirmation that the
9    individual is adequately trained to carry out corrosion
10    prevention and mitigation methods or inspections."; and
 
11by deleting all of pages 2 and 3; and
 
12on page 4 by deleting lines 1 through 12.
