| 4 | | "Section 5. The Department of Commerce and Economic | 5 | | Opportunity Law of the
Civil Administrative Code of Illinois is | 6 | | amended by adding Section 605-1020 as follows: | 7 | | (20 ILCS 605/605-1020 new) | 8 | | Sec. 605-1020. Barriers to paying child support; study. | 9 | | (a) Subject to appropriation, the Department shall conduct | 10 | | a study regarding the barriers individuals face to paying child | 11 | | support. The purpose of the study shall be to identify and | 12 | | minimize barriers to paying child support so as to decrease the | 13 | | total amount of unpaid child support in Illinois. The study | 14 | | shall focus on the following: | 15 | | (1) demographics of those who fail to pay child | 16 | | support, including: income, education level, age at first |

| 1 | | becoming a parent, ratio of monthly child support to | 2 | | monthly income, criminal history, child visits per month, | 3 | | number of children, substance abuse history, whether the | 4 | | individual is on probation or parole, and primary language | 5 | | spoken; | 6 | | (2) institutional barriers to paying child support, | 7 | | including how and when it is collected; | 8 | | (3) the impact, if any, that unpaid child support | 9 | | information has on an individual's ability to be | 10 | | considered, interviewed, and hired by an employer, | 11 | | including: (i) whether credit and background checks reveal | 12 | | unpaid child support obligations, including, but not | 13 | | limited to, amounts in arrears, civil judgments, and | 14 | | criminal convictions for failure to pay child support, and | 15 | | (ii) whether the information revealed in a credit or | 16 | | background check regarding unpaid child support prevents | 17 | | applicants from gaining employment. | 18 | | (b) The Department shall report the results of its study | 19 | | and any recommendations to the Governor and the General | 20 | | Assembly on or before May 1, 2017. | 21 | | (c) The Department shall, in consultation with the | 22 | | Department of Healthcare and Family Services, Child Support | 23 | | Division, adopt rules addressing the results and | 24 | | recommendations of the study. | 25 | | (d) This Section is repealed on January 1, 2018.
