AMENDMENT TO HOUSE BILL 2641

2    AMENDMENT NO. ______. Amend House Bill 2641 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Counties Code is amended by changing
5Section 4-11001 and by adding Section 4-11003 as follows:

8    Sec. 4-11001. Juror fees. Each county shall pay to grand
9and petit jurors for their services in attending courts the sum
10of $4 for each day of necessary attendance at such courts as
11jurors in counties of the first class, the sum of $5 for each
12day in counties of the second class, and the sum of $10 for
13each day in counties of the third class, or such higher amount
14as may be fixed by the county board.
15    In addition, jurors shall receive such travel expense as
16may be determined by the county board, provided that jurors in

1counties of the first class and second class shall receive at
2least 10 cents per mile for their travel expense. Mileage shall
3be allowed for travel during a juror's term as well as for
4travel at the opening and closing of his term.
5    If a judge so orders, a juror shall also receive
6reimbursement for the actual cost of day care incurred by the
7juror during his or her service on a jury.
8    The juror fees for service, transportation, and day care
9shall be paid out of the county treasury.
10    The clerk of the court shall furnish to each juror without
11fee whenever he is discharged a certificate of the number of
12days' attendance at court, and upon presentation thereof to the
13county treasurer, he shall pay to the juror the sum provided
14for his service.
15    Any juror may elect to waive the fee paid for service,
16transportation, or day care, or any combination thereof.

19    Sec. 4-11001. Juror fees.
20    (a) This subsection (a) is operative from June 1, 2015
21through November 30, 2015. Each county shall pay to grand and
22petit jurors for their services in attending courts the sums of
23$25 for the first day and thereafter $50 sum of $4 for each day
24of necessary attendance at such courts as jurors in counties of
25the first class, the sum of $5 for each day in counties of the

1second class, and the sum of $10 for each day in counties of
2the third class, or such higher amount as may be fixed by the
3county board.
4    In addition, jurors shall receive such travel expense as

22    (b) This subsection (b) is operative on and after December
231, 2015. Each county shall provide to grand and petit jurors
24for their services in attending courts the sums of $20 for the
25first and second day and thereafter $30 for each day of
26necessary attendance, which may include an offset for travel,

1meal and other expenses otherwise incurred by jurors associated
2with jury service, except for day care, as determined by the
3county board. The county board may fix and approve a higher
4amount to compensate jurors for their services, travel, meal
5and other expenses.
6    If a judge so orders, a juror shall also receive
7reimbursement for the actual cost of day care incurred by the
8juror during his or her service on a jury.
9    The juror fees for service, transportation, meals, day
10care, and other expenses incurred by jurors associated with
11jury service shall be funded out of the county treasury.
12    The clerk of the court shall furnish to each juror without
13fee whenever he or she is discharged a certificate of the
14number of days' attendance at court, and upon presentation
15thereof to the county treasurer, he or she shall pay to the
16juror the sum provided for his or her service.
17    Any juror may elect to waive the fee paid for service,
18transportation, or day care, or any combination thereof.

21    Sec. 4-11003. Juror services fee. In addition to the jury
22demand fees provided in the Clerks of Courts Act, a county
23board may enact by ordinance or resolution a juror services fee
24not to exceed $15 that is dedicated to defraying expenses
25incurred by the county in paying jurors for their services if

1the fee is justified by an acceptable cost study showing that
2the fee is necessary to defray the costs of paying jurors for
3their services. Such fee shall be paid in every civil action
4not quasi-criminal in its nature and not a proceeding for the
5exercise of the right of eminent domain and in every other
6action wherein the right of trial by jury is or may be given by
7law. The fee shall be paid by the party demanding a jury at the
8time of filing the jury demand.
9    All proceeds from this fee must be used to defray expenses
10incurred by the county in paying jurors for their services. The
11fees shall be collected in the manner in which all other court
12fees or costs are collected and shall be deposited into the
13county general fund for payment solely of costs incurred by the
14county in paying jurors for their services.
 
15    Section 95. No acceleration or delay. Where this Act makes
16changes in a statute that is represented in this Act by text
17that is not yet or no longer in effect (for example, a Section
18represented by multiple versions), the use of that text does
19not accelerate or delay the taking effect of (i) the changes
20made by this Act or (ii) provisions derived from any other
21Public Act.
 
22    Section 99. Effective date. This Act takes effect on June
231, 2015, except the provisions adding Section 4-11003 to the
24Counties Code take effect on December 1, 2015.".
