AMENDMENT TO HOUSE BILL 2556

2    AMENDMENT NO. ______. Amend House Bill 2556 by replacing
3everything after the enacting clause with the following:
 
4    "Section 1. Short title. This Act may be cited as the Human
5Trafficking Resource Center Notice Act.
 
6    Section 5. Posted notice required.
7    (a) Each of the following businesses and other
8establishments shall, upon the availability of the model notice
9described in Section 15 of this Act, post a notice that
10complies with the requirements of this Act in a conspicuous
11place near the public entrance of the establishment or in
12another conspicuous location in clear view of the public and
13employees where similar notices are customarily posted:
14        (1) On premise consumption retailer licensees under
15    the Liquor Control Act of 1934 where the sale of alcoholic
16    liquor is the principal business carried on by the licensee

1    at the premises and primary to the sale of food.
2        (2) Adult entertainment facilities, as defined in
3    Section 5-1097.5 of the Counties Code.
4        (3) Primary airports, as defined in Section 47102(16)
5    of Title 49 of the United States Code.
6        (4) Intercity passenger rail or light rail stations.
7        (5) Bus stations.
8        (6) Truck stops. For purposes of this Act, "truck stop"
9    means a privately-owned and operated facility that
10    provides food, fuel, shower or other sanitary facilities,
11    and lawful overnight truck parking.
12        (7) Emergency rooms within general acute care
13    hospitals.
14        (8) Urgent care centers.
15        (9) Farm labor contractors. For purposes of this Act,
16    "farm labor contractor" means: (i) any person who for a fee
17    or other valuable consideration recruits, supplies, or
18    hires, or transports in connection therewith, into or
19    within the State, any farmworker not of the contractor's
20    immediate family to work for, or under the direction,
21    supervision, or control of, a third person; or (ii) any
22    person who for a fee or other valuable consideration
23    recruits, supplies, or hires, or transports in connection
24    therewith, into or within the State, any farmworker not of
25    the contractor's immediate family, and who for a fee or
26    other valuable consideration directs, supervises, or

1    controls all or any part of the work of the farmworker or
2    who disburses wages to the farmworker. However, "farm labor
3    contractor" does not include full-time regular employees
4    of food processing companies when the employees are engaged
5    in recruiting for the companies if those employees are not
6    compensated according to the number of farmworkers they
7    recruit.
8        (10) Privately-operated job recruitment centers.
9    (b) The Department of Transportation shall, upon the
10availability of the model notice described in Section 15 of
11this Act, post a notice that complies with the requirements of
12this Act in a conspicuous place near the public entrance of
13each roadside rest area or in another conspicuous location in
14clear view of the public and employees where similar notices
15are customarily posted.
 
16    Section 10. Form of posted notice.
17    (a) The notice required under this Act shall be at least 8
181/2 inches by 11 inches in size, written in a 16-point font,
19and shall state the following:
 
20"If you or someone you know is being forced to engage in any
21activity and cannot leave, whether it is commercial sex,
22housework, farm work, construction, factory, retail, or
23restaurant work, or any other activity, call the National Human
24Trafficking Resource Center at 1-888-373-7888 to access help

1and services.
 
2Victims of slavery and human trafficking are protected under
3United States and Illinois law. The hotline is:
4        * Available 24 hours a day, 7 days a week.
5        * Toll-free.
6        * Operated by nonprofit nongovernmental organizations.
7        * Anonymous and confidential.
8        * Accessible in more than 160 languages.
9        * Able to provide help, referral to services, training,
10    and general information.".
 
11    (b) The notice shall be printed in English, Spanish, and in
12one other language that is the most widely spoken language in
13the county where the establishment is located and for which
14translation is mandated by the federal Voting Rights Act, as
15applicable. This subsection does not require a business or
16other establishment in a county where a language other than
17English or Spanish is the most widely spoken language to print
18the notice in more than one language in addition to English and
19Spanish.
 
20    Section 15. Model notice. No later than 6 months after the
21effective date of this Act, the Department of Human Services
22shall: (i) develop a model notice that complies with the
23requirements of Section 10 of this Act; or (ii) adopt a model

1notice developed by the Illinois Task Force on Human
2Trafficking that complies with the requirements of Section 10
3of this Act. The Department of Human Services shall make the
4model notice available for download on the Department's
5Internet website.
 
6    Section 20. Penalties.
7    (a) A business or establishment identified in subsection
8(a) of Section 5 that fails to comply with the requirements of
9this Act is liable for a civil penalty of $500 for a first
10offense and $1,000 for each subsequent offense.
11    (b) The Department of Labor shall, in the course of
12regulating a business or establishment, monitor and enforce
13compliance with this Act. Upon discovering a violation, the
14Department of Labor shall provide the business or establishment
15with reasonable notice of noncompliance that informs the
16business or establishment that it is subject to a civil penalty
17if it does not correct the violation within 30 days from the
18date the notice is sent to the business or establishment.
19    (c) If the Department of Labor verifies that the violation
20was not corrected within the 30-day period described in
21subsection (b), the Attorney General may bring an action to
22impose a civil penalty pursuant to this Section.".
