AMENDMENT TO HOUSE BILL 2404

2    AMENDMENT NO. ______. Amend House Bill 2404 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-315 as follows:
 
7    (20 ILCS 405/405-315)  (was 20 ILCS 405/67.24)
8    Sec. 405-315. Management of State buildings; security
9force; fees.
10    (a) To manage, operate, maintain, and preserve from waste
11the State buildings, facilities, structures, grounds, or other
12real property transferred to the Department under Section
13405-415, including, without limitation, the State buildings
14listed below. The Department may rent portions of these and
15other State buildings when in the judgment of the Director
16those leases or subleases will be in the best interests of the

1State. The leases or subleases shall not exceed 5 years unless

7associations, or individuals for terms not to exceed 15 years
8when in the judgment of the Director those leases or subleases
9will be in the best interests of the State.
10    Portions or all of the commercial space, which includes the
11sub-basement, storage mezzanine, concourse, and ground and
12second floors of the
13        James R. Thompson Center
14        Bounded by Lake, Clark, Randolph and LaSalle Streets
15        Chicago, Illinois
16may be leased or subleased to persons, firms, partnerships,
17associations, or individuals for terms not to exceed 15 years
18subject to renewals when in the judgment of the Director those
19leases or subleases will be in the best interests of the State.
20    The Director is authorized to rent portions of the above
21described facilities to persons, firms, partnerships,
22associations, or individuals for terms not to exceed 30 days
23when those leases or subleases will not interfere with State
24usage of the facility. This authority is meant to supplement
25and shall not in any way be interpreted to restrict the
26Director's ability to make portions of the State of Illinois

1Building and the James R. Thompson Center available for
2long-term commercial leases or subleases.
3    Notwithstanding the provisions above, the Department of
4Children and Family Services and the Department of Human
5Services (as successor to the Department of Rehabilitation
6Services and the Department of Mental Health and Developmental
7Disabilities) shall determine the allocation of space for
8direct recipient care in their respective facilities. The
9Department of Central Management Services shall consult with
10the affected agency in the allocation and lease of surplus
11space in these facilities. Potential lease arrangements shall
12not endanger the direct recipient care responsibilities in
13these facilities.
14    (b) To appoint, subject to the Personnel Code, persons to
15be members of a police and security force. Members of the
16security force shall be peace officers when performing duties
17pursuant to this Section and as such shall have all of the
18powers possessed by policemen in cities and sheriffs, including
19the power to make arrests on view or issue citations for
20violations of State statutes or city or county ordinances,
21except that in counties of more than 1,000,000 population, any
22powers created by this subsection shall be exercised only (i)
23when necessary to protect the property, personnel, or interests
24of the Department or any State agency for whom the Department
25manages, operates, or maintains property or (ii) when
26specifically requested by appropriate State or local law

1enforcement officials, and except that within counties of
21,000,000 or less population, these powers shall be exercised
3only when necessary to protect the property, personnel, or
4interests of the State of Illinois and only while on property
5managed, operated, or maintained by the Department.
6    Nothing in this subsection shall be construed so as to make
7it conflict with any provisions of, or rules promulgated under,
8the Personnel Code.
9    (c) To charge reasonable fees for the lease, rental, use,
10or occupancy of State facilities managed, operated, or
11maintained by the Department. All moneys collected under this
12Section shall be deposited in a revolving fund in the State
13treasury known as the Facilities Management Revolving Fund.
14    (d) Provisions of this Section relating to the James R.
15Thompson Center are subject to the provisions of Section 7.4 of
16the State Property Control Act.
17    (e) The use of electronic cigarettes, as that term is
18defined under Section 10-20.5c of the School Code, is
19prohibited in the hallways and common areas within any State
20governmental building, except in Illinois Veterans' Homes
21operated and maintained by the Illinois Department of Veterans'
22Affairs. For the purposes of this subsection (e), "State
23governmental building" means a structure owned by the State of
24Illinois or any of its agencies or by any State university or
25college or any of its corporate outgrowths thereof.

2    Section 10. The School Code is amended by adding Section
310-20.5c as follows:
 
4    (105 ILCS 5/10-20.5c new)
5    Sec. 10-20.5c. Prohibition of the use of electronic
6cigarettes. Each school board shall prohibit the use of
7electronic cigarettes on school property, including, but not
8limited to, in or on the grounds of any school, preschool, or
9day care facility, or at any off-campus school-sponsored or
10school-sanctioned event, by any school personnel, student, or
11other person when such property is being used for any school
12purposes. The school board may not authorize or permit any
13exception to or exemption from the prohibition at any place or
14at any time, including without limitation outside of school
15buildings, before or after the regular school day, or on days
16when school is not in session. "School purposes" include, but
17are not limited to, all events or activities or other use of
18school property that the school board or school officials
19authorize or permit on school property, including without
20limitation all interscholastic or extracurricular athletic,
21academic, or other events sponsored by the school board or in
22which pupils of the district participate. For purposes of this
23Section, "electronic cigarette" means: (i) any device that
24employs a battery or other mechanism to heat a solution or

1substance to produce a vapor or aerosol intended for
2inhalation; (ii) any cartridge or container of a solution or
3substance intended to be used with or in such device or to
4refill such a device; or (iii) any solution or substance,
5whether or not it contains nicotine, intended for use in such
6device. "Electronic cigarette" includes, but is not limited to,
7any electronic nicotine delivery system, electronic cigar,
8electronic cigarillo, electronic pipe, electronic hookah, vape
9pen, or similar product or device, and any components or parts
10that can be used to build such product or device. "Electronic
11cigarette" does not include cigarettes, as that term is defined
12under Section 1 of the Cigarette Tax Act, and tobacco products,
13as that term is defined under Section 10-5 of the Tobacco
14Products Tax Act of 1995. "Electronic cigarette" does not
15include any asthma inhaler or any product that has been
16approved by the United States Food and Drug Administration for
17tobacco cessation, nicotine cessation, or other therapeutic
18purpose if that product is marketed and sold solely for that
19approved purpose. "Electronic cigarette" does not include any
20device used by a registered qualifying patient under the
21Compassionate Use of Medical Cannabis Pilot Program for the
22ingestion of cannabis.
 
23    Section 15. The Board of Higher Education Act is amended by
24adding Section 20 as follows:

1    (110 ILCS 205/20 new)
2    Sec. 20. Prohibition of use of electronic cigarettes. The
3use of electronic cigarettes, as that term is defined in
4Section 10-20.5c of the School Code, shall be prohibited in any
5dormitory of any public or nonpublic institution of higher
6education. For purposes of this Section, "nonpublic
7institution of higher education" has the meaning given to that
8term in Section 2 of the Higher Education Cooperation Act.".
