2    AMENDMENT NO. ______. Amend House Bill 2404 by replacing
3everything after the enacting clause with the following:
4    "Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-315 as follows:
7    (20 ILCS 405/405-315)  (was 20 ILCS 405/67.24)
8    Sec. 405-315. Management of State buildings; security
9force; fees.
10    (a) To manage, operate, maintain, and preserve from waste
11the State buildings, facilities, structures, grounds, or other
12real property transferred to the Department under Section
13405-415, including, without limitation, the State buildings
14listed below. The Department may rent portions of these and
15other State buildings when in the judgment of the Director
16those leases or subleases will be in the best interests of the

1State. The leases or subleases shall not exceed 5 years unless

7associations, or individuals for terms not to exceed 15 years
8when in the judgment of the Director those leases or subleases
9will be in the best interests of the State.
10    Portions or all of the commercial space, which includes the
11sub-basement, storage mezzanine, concourse, and ground and
12second floors of the
13        James R. Thompson Center
14        Bounded by Lake, Clark, Randolph and LaSalle Streets
15        Chicago, Illinois
16may be leased or subleased to persons, firms, partnerships,
17associations, or individuals for terms not to exceed 15 years
18subject to renewals when in the judgment of the Director those
19leases or subleases will be in the best interests of the State.
20    The Director is authorized to rent portions of the above
21described facilities to persons, firms, partnerships,
22associations, or individuals for terms not to exceed 30 days
23when those leases or subleases will not interfere with State
24usage of the facility. This authority is meant to supplement
25and shall not in any way be interpreted to restrict the
26Director's ability to make portions of the State of Illinois

1Building and the James R. Thompson Center available for
2long-term commercial leases or subleases.
3    Notwithstanding the provisions above, the Department of
4Children and Family Services and the Department of Human
5Services (as successor to the Department of Rehabilitation
6Services and the Department of Mental Health and Developmental
7Disabilities) shall determine the allocation of space for
8direct recipient care in their respective facilities. The
9Department of Central Management Services shall consult with
10the affected agency in the allocation and lease of surplus
11space in these facilities. Potential lease arrangements shall
12not endanger the direct recipient care responsibilities in
13these facilities.
14    (b) To appoint, subject to the Personnel Code, persons to
15be members of a police and security force. Members of the
16security force shall be peace officers when performing duties
17pursuant to this Section and as such shall have all of the
18powers possessed by policemen in cities and sheriffs, including
19the power to make arrests on view or issue citations for
20violations of State statutes or city or county ordinances,
21except that in counties of more than 1,000,000 population, any
22powers created by this subsection shall be exercised only (i)
23when necessary to protect the property, personnel, or interests
24of the Department or any State agency for whom the Department
25manages, operates, or maintains property or (ii) when
26specifically requested by appropriate State or local law

1enforcement officials, and except that within counties of
21,000,000 or less population, these powers shall be exercised
3only when necessary to protect the property, personnel, or
4interests of the State of Illinois and only while on property
5managed, operated, or maintained by the Department.
6    Nothing in this subsection shall be construed so as to make
7it conflict with any provisions of, or rules promulgated under,
8the Personnel Code.
9    (c) To charge reasonable fees for the lease, rental, use,
10or occupancy of State facilities managed, operated, or
11maintained by the Department. All moneys collected under this
12Section shall be deposited in a revolving fund in the State
13treasury known as the Facilities Management Revolving Fund.
14    (d) Provisions of this Section relating to the James R.
15Thompson Center are subject to the provisions of Section 7.4 of
16the State Property Control Act.
17    (e) The use of vapor products, as that term is defined
18under Section 10-20.5c of the School Code, is prohibited in the
19hallways and common areas within any State governmental
20building except in Illinois Veterans' Homes operated and
21maintained by the Illinois Department of Veterans' Affairs. For
22the purposes of this subsection (e), "State governmental
23building" means a structure owned by the State of Illinois or
24any of its agencies or by any State university or college or
25any of its corporate outgrowths thereof.

2    Section 10. The School Code is amended by adding Section
310-20.5c as follows:
4    (105 ILCS 5/10-20.5c new)
5    Sec. 10-20.5c. Prohibition of the use of vapor products.
6Each school board shall prohibit the use of vapor products on
7school property, including, but not limited to, in or on the
8grounds of any school, preschool, or day care facility, or at
9any off-campus school-sponsored or school-sanctioned event, by
10any school personnel, student, or other person when such
11property is being used for any school purposes. The school
12board may not authorize or permit any exception to or exemption
13from the prohibition at any place or at any time, including
14without limitation outside of school buildings, before or after
15the regular school day, or on days when school is not in
16session. "School purposes" include, but are not limited to, all
17events or activities or other use of school property that the
18school board or school officials authorize or permit on school
19property, including without limitation all interscholastic or
20extracurricular athletic, academic, or other events sponsored
21by the school board or in which pupils of the district
22participate. For purposes of this Section "vapor product" means
23any non-combustible tobacco-derived product containing
24nicotine, such as an electronic cigarette, that employs a

1mechanical heating element, battery, or electronic circuit,
2regardless of shape or size, that can be used to heat a liquid
3nicotine solution that can be used with or in a vapor product.
4"Vapor product" does not include cigarettes, as that term is
5defined under Section 1 of the Cigarette Tax Act, and tobacco
6products, as that term is defined under Section 10-5 of the
7Tobacco Products Tax Act of 1995. "Vapor product" does not
8include any asthma inhaler or any product regulated by the
9United States Food and Drug Administration under Chapter V of
10the Federal Food, Drug, and Cosmetic Act.
11    Section 15. The Board of Higher Education Act is amended by
12adding Section 20 as follows:
13    (110 ILCS 205/20 new)
14    Sec. 20. Prohibition of use of vapor products. The use of
15vapor products, as that term is defined in Section 10-20.5c of
16the School Code, shall be prohibited in any dormitory of any
17public or nonpublic institution of higher education. For
18purposes of this Section, "nonpublic institution of higher
19education" has the meaning given to that term in Section 2 of
20the Higher Education Cooperation Act.".
