AMENDMENT TO HOUSE BILL 205

2    AMENDMENT NO. ______. Amend House Bill 205 as follows:
 
3on page 1, immediately below line 3, by inserting the
4following:
 
5    "Section 1. The Department of Human Services Act is amended
6by adding Section 10-61 as follows:
 
7    (20 ILCS 1305/10-61 new)
8    Sec. 10-61. Community mental health centers; income
9verification. The Department shall not require community
10mental health centers participating in the Medicaid community
11mental health services program established under 59 Ill. Adm.
12Code 132 to require recipients of medical assistance under
13Article V of the Illinois Public Aid Code to provide
14documentation of income.

3    Section 10. The Community Services Act is amended by adding
4Section 4.9 as follows:
 
5    (405 ILCS 30/4.9 new)
6    Sec. 4.9. Mental health professional; definition. As used
7in 59 Ill. Adm. Code 132, "mental health professional" or "MHP"
8means an individual who provides services under the supervision
9of a qualified mental health professional and who possesses: a
10bachelor's degree; a practical nurse license under the Nurse
11Practice Act; a certificate of psychiatric rehabilitation from
12a program approved by the Department of Human Services plus a
13high school diploma or high school equivalency certificate plus
142 years' experience in providing mental health services; a
15recovery support specialist certificate from, and in good
16standing with, the Illinois Alcohol and Other Drug Abuse
17Professional Certification Association, Inc.; a family
18partnership professional certificate from, and in good
19standing with, the Illinois Alcohol and Other Drug Abuse
20Professional Certification Association, Inc.; an occupational
21therapy assistant license under the Illinois Occupational
22Therapy Practice Act with at least one year of experience in a
23mental health setting; or a minimum of a high school diploma or
24high school equivalency certificate and 5 years' supervised

1clinical experience in mental health or human services. A
2supervised internship in a mental health setting counts toward
3the experience in providing mental health services. An
4individual meeting the minimum credentials for a Licensed
5Practitioner of the Healing Arts or Qualified Mental Health
6Professional as defined by the Department of Human Services, by
7rule, is deemed to also meet the credentialing requirements of
8a mental health professional. Any individual employed as a
9mental health professional before July 1, 2013 may continue to
10be so designated unless employment changes.".
