| 2 | | AMENDMENT NO. ______. Amend Senate Bill 1689, AS AMENDED, | 3 | | by replacing everything after the enacting clause with the | 4 | | following:
| 5 | | "Section 5. The Election Code is amended by adding Section | 6 | | 7-67 as follows: | 7 | | (10 ILCS 5/7-67 new) | 8 | | Sec. 7-67. Nominations; regional superintendents of | 9 | | schools. | 10 | | (a) Notwithstanding any provision of law to the contrary, | 11 | | this Section shall apply only to the making of nominations for | 12 | | established party candidates for regional superintendent of | 13 | | schools in the 2014 general primary election. | 14 | | (b) A candidate's petition for nomination must contain at | 15 | | least 200 signatures or the number of signatures equal to 0.5% | 16 | | of the primary electors of his or her party in the territory |

| 1 | | comprising the county or counties, whichever is less. For | 2 | | purposes of this subsection, the number of primary electors | 3 | | shall be determined by taking the total votes cast in the | 4 | | applicable district for the candidate for that political party | 5 | | who received the highest number of votes, statewide, at the | 6 | | last general election in the State at which electors for | 7 | | President of the United States were elected. | 8 | | (c) Petitions for nomination for regional superintendent | 9 | | of schools shall be filed no earlier than December 16, 2013, | 10 | | and no later than December 23, 2013. | 11 | | (d) Petitions for single-county districts shall be filed | 12 | | with the county election authority. Petitions for multi-county | 13 | | districts shall be filed with the State Board of Elections. | 14 | | Signatures and circulator statements on petitions for | 15 | | nomination filed with the State Board of Elections or county | 16 | | election authority during the filing period for nominations | 17 | | shall not be deemed invalid for the sole reason that the | 18 | | petitions were circulated between 90 and 111 days before the | 19 | | last day for filing petitions. | 20 | | (e) In the case of a conflict between the provisions of | 21 | | this Section and any other provision of this Code, the | 22 | | provisions of this Section shall control. | 23 | | Section 10. The School Code is amended by changing Section | 24 | | 3A-4 as follows:

| 2 | | Sec. 3A-4. Mandatory consolidation of educational service | 3 | | regions.
| 4 | | (a) After July 1, 2015,
each
region must contain at least | 5 | | 61,000 inhabitants. Before June 30, 2013, regions may be | 6 | | consolidated
voluntarily under Section 3A-3 or by joint | 7 | | resolution of the county boards of
regions seeking to join a | 8 | | voluntary consolidation, effective July 1, 2015, to meet these | 9 | | population
requirements. The boundaries of regions already | 10 | | meeting these population
requirements on the effective date of | 11 | | Public Act 97-703 this amendatory Act of the 97th General | 12 | | Assembly may not be
changed except to consolidate with another | 13 | | region or a whole county portion of
another region which does | 14 | | not meet these population requirements.
If, before November 1, | 15 | | 2013 January 1, 2014 , locally determined consolidation | 16 | | decisions result in more than 35 regions of
population greater | 17 | | than 61,000 each, the State Board of Education shall, before | 18 | | November 23, 2013 June 1, 2014 , direct
further consolidation, | 19 | | beginning with the region of lowest population, until
the | 20 | | number of 35 regions is achieved.

| 22 | | (c) If, within 90 days after the most recent certified | 23 | | federal census, a region does not meet the population | 24 | | requirements of this Section, then regions may be consolidated | 25 | | voluntarily under Section 3A-3 of this Code or by joint | 26 | | resolution of the county boards of regions seeking to join a |

| 1 | | voluntary consolidation to meet these population requirements. | 2 | | If locally determined consolidation decisions result in a | 3 | | region not meeting the population requirements of this Section | 4 | | or result in more than 35 regions, then the State Board of | 5 | | Education shall have the authority to impose further | 6 | | consolidation by order of the State Superintendent of | 7 | | Education. Such an order shall be a final order and is subject | 8 | | to the Administrative Review Law.
| 9 | | (d) All population determinations shall be based on the | 10 | | most recent
federal census.
