AMENDMENT TO HOUSE BILL 4983

2    AMENDMENT NO. ______. Amend House Bill 4983 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Township Code is amended by changing
5Section 70-15 as follows:
 
6    (60 ILCS 1/70-15)
7    Sec. 70-15. Chief executive officer; fiscal duties;
8penalty for neglect.
9    (a) The supervisor is the chief executive officer of the
10township.
11    (b) The supervisor shall receive and pay out all moneys
12raised in the township for defraying township charges, except
13those raised for the support of highways and bridges, and for
14township library purposes.
15    In addition, the township board of trustees may designate a
16co-signer for the payout of all township moneys. Only an

1elected township official may serve as a co-signer. Before an
2elected township official may perform the duties of a
3co-signer, he or she shall give bond to the township with one
4or more sureties: (i) in at least twice the amount of money
5that may come into the supervisor's hands, if individuals act
6as sureties, or (ii) only in the amount of money that may come
7into the supervisor's hands if a surety company authorized to
8do business in this State acts as surety. The bond shall be
9conditioned on the faithful discharge of his or her duties as
10co-signer, approved by the supervisor, and filed with the
11township clerk. If the township board of trustees determines
12that the bond has been forfeited, the co-signer shall no longer
13have the authority granted to him or her under this Section.
14    (c) The supervisor shall, within 30 days before the annual
15township meeting, prepare and file with the township clerk a
16full statement of the financial affairs of the township,
17showing (i) the balance (if any) received by the supervisor
18from his or her predecessor in office or from any other source;
19(ii) the amount of tax levied the preceding year for the
20payment of township indebtedness and charges; (iii) the amount
21collected and paid over to the supervisor as supervisor; (iv)
22the amount paid out by the supervisor and on what account,
23including any amount paid out on township indebtedness,
24specifying the nature and amount of the township indebtedness,
25the amount paid on the indebtedness, the amount paid on
26principal, and the amount paid on interest account; and (v) the

1amount and kind of all outstanding indebtedness due and unpaid,
2the amount and kind of indebtedness not yet due, and when the
3indebtedness not yet due will mature. The township clerk shall
4record the statement in the record book of the township as soon
5as it is filed and shall post a copy of the statement at the
6place of holding the annual township meeting 2 days before the
7meeting is held. The clerk shall also read aloud the statement
8to the electors at the annual township meeting.
9    (d) Any supervisor or township clerk who wilfully neglects
10to comply with this Section shall forfeit and pay to the
11township the sum of not less than $50 nor more than $200. The
12amount forfeited shall be sued for and recovered by the
13township in its corporate name and shall be appropriated to
14repairs of highways and bridges in the township.

16    Section 10. The Illinois Highway Code is amended by
17changing Section 6-205 as follows:
 
18    (605 ILCS 5/6-205)  (from Ch. 121, par. 6-205)
19    Sec. 6-205. The district treasurer shall receive and have
20charge of all moneys raised in the district for the support and
21maintenance of roads therein, and for road damages except such
22portions of the moneys which by Section 6-507 are directed to
23be paid to the municipalities. He or she shall hold such moneys
24at all times subject to the order of the highway commissioner

1and shall pay them over upon the order of the commissioner,
2such order to be countersigned by the town or district clerk.
3In counties under township organization such moneys, other than
4Social Security taxes required by the Social Security Enabling
5Act, shall not be paid over until the board of town trustees or
6highway board of auditors, as the case may be, has examined and
7audited the claims or charges for which such order is drawn. He
8or she shall keep an account in a book provided by the
9commissioner of all moneys received, and all moneys paid out,
10showing in detail to whom and on what account the same is so
11paid.
12    The township board of trustees or the highway board of
13auditors may designate a co-signer for the payout of all road
14district moneys. Only an elected township or road district
15official may serve as a co-signer. Before an elected township
16or road district official may perform the duties of a
17co-signer, he or she shall give bond to the township with one
18or more sureties: (i) in at least twice the amount of money
19that may come into the supervisor's hands, if individuals act
20as sureties, or (ii) only in the amount of money that may come
21into the supervisor's hands if a surety company authorized to
22do business in this State acts as surety. The bond shall be
23conditioned on the faithful discharge of his or her duties as
24co-signer, approved by the supervisor, and filed with the
25township clerk. If the township board determines that the bond
26has been forfeited, the co-signer shall no longer have the

2    The treasurer shall also present annually, within 30 days
3after the end of the fiscal year of the district, to the
4highway commissioner an itemized statement of receipts and
5disbursements of the district during the fiscal year just
6ended, which shall be sworn to.

8    Section 99. Effective date. This Act takes effect January
91, 2015.".
