| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Metropolitan Transit Authority Act is | 5 | | amended by changing Section 23 as follows:
| 6 | | (70 ILCS 3605/23) (from Ch. 111 2/3, par. 323)
| 7 | | Sec. 23.
Regular meetings of the Board shall be held at | 8 | | least once in each
calendar month, the time and place of such | 9 | | meetings to be fixed by the
Board. Four members of the Board | 10 | | shall constitute a quorum for the
transaction of business. All | 11 | | action of the Board shall be by ordinance or
resolution and the | 12 | | affirmative vote of at least four members shall be
necessary | 13 | | for the adoption of any ordinance or resolution. All such
| 14 | | ordinances and resolutions before taking effect shall be | 15 | | approved by the
chairman of the Board, and if he shall approve | 16 | | thereof he shall sign the
same, and such as he shall not | 17 | | approve he shall return to the Board with
his objections | 18 | | thereto in writing at the next regular meeting of the Board
| 19 | | occurring after the passage thereof. But in case the chairman | 20 | | shall fail to
return any ordinance or resolution with his | 21 | | objections thereto by the time
aforesaid, he shall be deemed to | 22 | | have approved the same and it shall take

| 1 | | with his objections, the vote by which the same was passed | 2 | | shall
be reconsidered by the Board, and if upon such | 3 | | reconsideration said
ordinance or resolution is passed by the | 4 | | affirmative vote of at least five
members, it shall go into | 5 | | effect notwithstanding the veto of the chairman.
All | 6 | | ordinances, resolutions and all proceedings of the Authority | 7 | | and all
documents and records in its possession shall be public | 8 | | records, and open
to public inspection, except such documents | 9 | | and records as shall be kept or
prepared by the Board for use | 10 | | in negotiations, action or proceedings to
which the Authority | 11 | | is a party. | 12 | | Open meetings of the Board shall be broadcast to the public | 13 | | and maintained in real-time on the Board's website using a | 14 | | high-speed Internet connection. Recordings of each meeting | 15 | | broadcast shall be posted to the Board's website within a | 16 | | reasonable time after the meeting and shall be maintained as | 17 | | public records to the extent practicable, as determined by the | 18 | | Board. Compliance with the provisions of this amendatory Act of | 19 | | the 98th General Assembly does not relieve the Board of its | 20 | | obligations under the Open Meetings Act.

| 22 | | Section 10. The Regional Transportation Authority Act is | 23 | | amended by changing Sections 3.05, 3A.07, and 3B.07 as follows:

| 1 | | Sec. 3.05. Meetings. The Board shall prescribe the times | 2 | | and places for meetings and the
manner in which special | 3 | | meetings may be called. The Board shall comply
in all respects | 4 | | with the "Open Meetings Act", approved July 11,
1957, as now or | 5 | | hereafter amended. All records, documents and papers of
the | 6 | | Authority, other than those relating to matters concerning | 7 | | which
closed sessions of the Board may be held, shall be | 8 | | available for public
examination, subject to such reasonable | 9 | | regulations as the Board may
adopt.
| 10 | | A majority of the Directors holding office shall constitute | 11 | | a quorum
for the conduct of business. Except as otherwise | 12 | | provided in this Act,
the affirmative votes of at least 9
| 13 | | Directors shall be necessary for
approving any contract or | 14 | | agreement, adopting any rule or regulation,
and any other | 15 | | action required by this Act to be taken by resolution or
| 16 | | ordinance.
| 17 | | The Board shall meet with the Regional Citizens Advisory | 18 | | Board at least
once every 4 months.
| 19 | | Open meetings of the Board shall be broadcast to the public | 20 | | and maintained in real-time on the Board's website using a | 21 | | high-speed Internet connection. Recordings of each meeting | 22 | | broadcast shall be posted to the Board's website within a | 23 | | reasonable time after the meeting and shall be maintained as | 24 | | public records to the extent practicable, as determined by the | 25 | | Board. called. The Suburban Bus Board | 7 | | shall comply in all respects with the "Open
Meetings Act", as | 8 | | now or hereafter amended. All records, documents and
papers of | 9 | | the Suburban Bus Division, other than those relating to matters
| 10 | | concerning which closed sessions of the Suburban Bus Board may | 11 | | be held,
shall be available for public examination, subject to | 12 | | such reasonable regulations
as the Suburban Bus Board may | 13 | | adopt.
| 14 | | A majority of the members shall constitute a quorum for the | 15 | | conduct of
business. The affirmative votes of at least 7 | 16 | | members shall be necessary
for any action required by this Act | 17 | | to be taken by ordinance.

and places for meetings and the manner in | 6 | | which special meetings may be
called. The Commuter Rail Board | 7 | | shall comply in all respects with the "Open
Meetings Act", as | 8 | | now or hereafter amended. All records, documents and
papers of | 9 | | the Commuter Rail Division, other than those relating to | 10 | | matters
concerning which closed sessions of the Commuter Rail | 11 | | Board may be held,
shall be available for public examination, | 12 | | subject to such reasonable regulations
as the board may adopt.
| 13 | | A majority of the members shall constitute a quorum for the | 14 | | conduct of
business. The affirmative votes of at least 6
| 15 | | members shall be necessary
