AMENDMENT TO HOUSE BILL 4850

2    AMENDMENT NO. ______. Amend House Bill 4850 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The School Code is amended by adding Sections
510-30 and 34-21.9 as follows:
 
6    (105 ILCS 5/10-30 new)
7    Sec. 10-30. Mandate compliance; delayed State payments.
8    (a) If any payments from the State to a school district are
9delayed, then the school district is not obligated to comply
10with the following statutory mandates during that time:
11        (1) State assessments for writing;
12        (2) requirements for school districts to identify,
13    track, and report on the educational progress and outcomes
14    of dropouts who have re-enrolled in school, as required by
15    subsection (e) of Section 26-2 of this Code;
16        (3) requirements for school districts to use 5%

1    biodiesel fuel in their busses, as required by Section
2    12-705.1 of the Illinois Vehicle Code;
3        (4) requirements for school districts to have the
4    designated integrated pest management person attend a
5    training course, as required by Section 10.2 of the
6    Structural Pest Control Act;
7        (5) requirements that school districts provide summer
8    breakfast or lunch programs for the duration of their
9    summer school program in each school that has at least 50%
10    of the students eligible for free or reduced-price lunch,
11    as required by Section 20 of the Childhood Hunger Relief
12    Act;
13        (6) requirements that school districts that apply for
14    school construction grants receive certification from a
15    green building rating system, as required by Section 5-40
16    of the School Construction Law;
17        (7) requirements on school districts that construction
18    projects meet all energy and environmental standards as
19    required by the Green Buildings Act;
20        (8) requirements that school districts grant 20 days of
21    paid leave of absence for any employee that serves as a
22    trustee on the Illinois Municipal Retirement Fund's Board
23    of Trustees, as required by Section 24-6.3 of this Code;
24    and
25        (9) requirements for driver education, as required by
26    the Driver Education Act, Sections 27-24 through 27-24.8 of

1    this Code.
2    (b) If payments are delayed as described in subsection (a)
3of this Section, then a school district may choose to
4discontinue or modify any of the mandated activities listed
5under subsection (a) of this Section. Official action by the
6school board must take place before a school district may
7choose to discontinue a mandated activity due to delayed
8payments from the State. If a school district discontinues or
9modifies a mandated activity due to delayed payments from the
10State, then the school district shall maintain a list of all
11discontinued or modified activities. The list shall be provided
12to the State Board of Education upon request.
