SYNOPSIS AS INTRODUCED:
 
20 ILCS 1705/10.1  from Ch. 91 1/2, par. 100-10.1

    Amends the Mental Health and Developmental Disabilities Administrative Act. Requires the Department of Human Services to record the menstrual cycles of every woman of child-bearing age who is admitted to and remains in a mental health facility for more than 60 days. Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Mental Health and Developmental
5Disabilities Administrative Act is amended by changing Section
610.1 as follows:
 
7    (20 ILCS 1705/10.1)  (from Ch. 91 1/2, par. 100-10.1)
8    Sec. 10.1. Every woman of child-bearing age who is admitted
9to a facility under the jurisdiction of the Department shall,
10with her consent or the consent of her guardian, be tested for
11pregnancy upon admission and thereafter as indicated. For a
12recipient who is admitted to and remains in a facility for more
13than 60 days a A record of each such recipient's menstrual
14cycles shall be maintained. A plan for complete prenatal care
15shall be developed and implemented for each recipient who is
16found to be pregnant. On-site prenatal care shall be provided
17to recipients who are not verbal or who otherwise cannot
18communicate with a provider of care because of a severe
19disability, in which case the facility administrator shall also
20seek the consent of the recipient's legal guardian for special
21care for the recipient, or shall arrange for a temporary or
22limited guardianship of the person of the recipient for the
23purpose of obtaining consent to diagnosis and treatment of the

1recipient. Discharge planning for a pregnant recipient shall
2specifically include provision for continuity of prenatal
3care.
