| 2 | | AMENDMENT NO. ______. Amend House Bill 1415, AS AMENDED, by | 3 | | replacing everything after the enacting clause with the | 4 | | following:
| 5 | | "Section 5. The School Code is amended by changing Sections | 6 | | 2-3.25f and 10-19.1 as follows:
| 7 | | (105 ILCS 5/2-3.25f) (from Ch. 122, par. 2-3.25f)
| 8 | | Sec. 2-3.25f. State interventions.
| 9 | | (a) The State Board of Education shall provide technical
| 10 | | assistance to assist with the development and implementation of | 11 | | School and District Improvement Plans.
| 12 | | Schools or school districts that fail to make reasonable | 13 | | efforts to
implement an
approved Improvement Plan may suffer | 14 | | loss of State funds by school
district, attendance center, or | 15 | | program as the State Board of Education
deems appropriate.
| 16 | | (a-5) In this subsection (a-5), "school" means any of the |

| 1 | | agreement until the expiration of the next collective | 2 | | bargaining agreement. A school board must notify the State | 3 | | Board of Education of its intent to opt in the process of | 4 | | operating a school on a pilot full-year school plan. | 5 | | (b) In addition, if after 3 years following its placement | 6 | | on
academic
watch status a school district or school remains on
| 7 | | academic watch status, the
State Board of Education shall take | 8 | | one of the following actions for the
district or
school:
| 9 | | (1) The State Board of Education may authorize the | 10 | | State
Superintendent
of Education to direct the regional | 11 | | superintendent of schools to remove
school board members | 12 | | pursuant to Section 3-14.28 of this Code. Prior
to such | 13 | | direction the State Board of Education shall permit members | 14 | | of the
local board of education to present written and oral | 15 | | comments to the State
Board of Education. The State Board | 16 | | of Education may direct the State
Superintendent of | 17 | | Education to appoint an Independent Authority that shall
| 18 | | exercise such powers and duties as may be necessary to | 19 | | operate a school or
school district for purposes of | 20 | | improving pupil performance and school
improvement. The | 21 | | State Superintendent of Education shall designate one
| 22 | | member of the Independent Authority to serve as chairman. | 23 | | The Independent
Authority shall serve for a period of time | 24 | | specified by the State Board of
Education upon the | 25 | | recommendation of the State Superintendent of
Education.
| 26 | | (2) The State Board of Education may (A)
change the |

| 1 | | recognition status of the school district or school to
| 2 | | nonrecognized, or (B) authorize the State Superintendent
| 3 | | of Education to direct the reassignment of pupils
or direct | 4 | | the reassignment or replacement of school district | 5 | | personnel who
are relevant to the
failure
to
meet adequate | 6 | | yearly progress criteria. If
a school district is | 7 | | nonrecognized in its entirety, it shall automatically
be | 8 | | dissolved on July 1 following that nonrecognition and its | 9 | | territory
realigned with another school district or | 10 | | districts by the regional board
of school trustees in | 11 | | accordance with the procedures set forth in Section
7-11 of | 12 | | the School Code. The effective date of the nonrecognition | 13 | | of a school
shall be July 1 following the nonrecognition.
| 14 | | (c) All federal requirements apply to schools and school | 15 | | districts
utilizing
federal funds under Title I, Part A of the | 16 | | federal Elementary and Secondary
Education Act of 1965.

| 19 | | Sec. 10-19.1. Full year school plan. | 20 | | (a) Any school district may, by resolution of its board, | 21 | | operate one or
more schools within the district on a full year | 22 | | school plan approved by
the State Board of Education.
Any board | 23 | | which operates under
this subsection (a) Section shall devise a | 24 | | plan so that a student's required attendance
in school shall be | 25 | | for a minimum term of 180 days of actual attendance,
including |

| 1 | | not more than 4 institute days, during a 12 month period, but
| 2 | | shall not exceed 185 days. Under such plan, no teacher shall be | 3 | | required
to teach more than 185 days. A calendar of 180 days | 4 | | may be established
with the approval of the State Board of | 5 | | Education.
| 6 | | (b) Any school board that operates one or more schools | 7 | | within the school district on a pilot full-year school plan | 8 | | under subsection (a-5) of Section 2-3.25f of this Code shall | 9 | | devise a plan so that a student's required attendance in school | 10 | | shall be for a minimum term of 215 days of actual attendance, | 11 | | including not more than 4 institute days, during a 12-month | 12 | | period. A calendar of 215 days may be established with the | 13 | | approval of the State Board of Education. | 14 | | (Source: P.A. 81-1508.)".
