| 1 | | AN ACT concerning education.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Code is amended by changing Section | 5 | | 30-9 as follows:
| 6 | | (105 ILCS 5/30-9) (from Ch. 122, par. 30-9)
| 7 | | Sec. 30-9. General Assembly scholarship; conditions of | 8 | | admission; award by
competitive examination. | 9 | | (a) In this Section, "relative" means a person related to | 10 | | an individual as father, mother, son, daughter, brother, | 11 | | sister, uncle, aunt, great aunt, great uncle, first cousin, | 12 | | nephew, niece, husband, wife, grandfather, grandmother, | 13 | | grandson, granddaughter, father-in-law, mother-in-law, | 14 | | son-in-law, daughter-in-law, brother-in-law, sister-in-law, | 15 | | stepfather, stepmother, stepson, stepdaughter, stepbrother, | 16 | | stepsister, half brother, or half sister and includes the | 17 | | father, mother, grandfather, or grandmother of the | 18 | | individual's spouse and the individual's fiance or fiancee. | 19 | | (b) Each member of the General Assembly may nominate | 20 | | annually 2 persons of
school age and otherwise eligible, from | 21 | | his district; each shall
receive a
certificate of scholarship | 22 | | in any State supported
university designated by the member. Any | 23 | | member of the General Assembly in

| 1 | | Section may designate that his nominee be
granted a 4 year | 2 | | scholarship or may instead designate 2 or 4 nominees for
that | 3 | | particular scholarship, each to receive a 2 year or a one year
| 4 | | scholarship, respectively. A nominee must not be a relative of | 5 | | the member making the nomination. The nominee, if a graduate of | 6 | | a school
accredited by the University to which nominated, shall | 7 | | be admitted to the
university on the same conditions as to | 8 | | educational qualifications as are
other graduates of | 9 | | accredited schools. If the nominee is not a graduate of
a | 10 | | school accredited by the university to which nominated, he | 11 | | must, before
being entitled to the benefits of the scholarship, | 12 | | pass an examination
given by the superintendent of schools of | 13 | | the county where he resides at
the time stated in Section 30-7 | 14 | | for the competitive examination. The
president of each | 15 | | university shall prescribe the rules governing the
examination | 16 | | for scholarship to his university.
| 17 | | (c) A member of the General Assembly may award the | 18 | | scholarship by
competitive examination conducted under like | 19 | | rules as prescribed in Section
30-7 even though one or more of | 20 | | the applicants are graduates of schools
accredited by the | 21 | | university.
| 22 | | (d) A member of the General Assembly may delegate to the | 23 | | Illinois Student
Assistance Commission the authority to | 24 | | nominate persons for General Assembly
scholarships which that | 25 | | member would otherwise be entitled to award, or may
direct the | 26 | | Commission to evaluate and make recommendations to the member

| 1 | | concerning candidates for such scholarships. In the event a | 2 | | member
delegates his nominating authority or directs the | 3 | | Commission to evaluate
and make recommendations concerning | 4 | | candidates for General Assembly
scholarships, the member shall | 5 | | inform the Commission in writing of the
criteria which he | 6 | | wishes the Commission to apply in nominating or
recommending | 7 | | candidates. Those criteria may include some or all of the
| 8 | | criteria provided in Section 25 of the Higher Education Student
| 9 | | Assistance Act. A delegation of authority under this subsection | 10 | | (d) paragraph may be revoked
at any time by the member.
| 11 | | (e) Failure of a member of the General Assembly to make a | 12 | | nomination in any
year shall not cause that scholarship to | 13 | | lapse, but the member may make a
nomination for such | 14 | | scholarship at any time thereafter before the
expiration of his | 15 | | term, and the person so nominated shall be entitled to
the same | 16 | | benefits as holders of other scholarships provided herein. Any
| 17 | | such scholarship for which a member has made no nomination | 18 | | prior to the
expiration of the term for which he was elected | 19 | | shall lapse upon the
expiration of that term.

| 21 | | Section 99. Effective date. This Act takes effect upon | 22 | | becoming law.
