Amends the School Code. With respect to nominees for General Assembly scholarships, prohibits a nominee from being a relative of the member of the General Assembly making the nomination; defines relative. Provides that each member of the General Assembly shall (instead of may) delegate to the Illinois Student Assistance Commission the authority to nominate persons for General Assembly scholarships that the member would otherwise be entitled to award. Provides that the member shall make recommendations to the Commission concerning candidates for the scholarships and may inform the Commission in writing of the criteria that he or she wishes the Commission to apply in nominating candidates. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The School Code is amended by changing Section | 5 | | 30-9 as follows:
| 6 | | (105 ILCS 5/30-9) (from Ch. 122, par. 30-9)
| 7 | | Sec. 30-9. General Assembly scholarship; conditions of | 8 | | admission; award by
competitive examination. | 9 | | (a) In this Section, "relative" means a person related to | 10 | | an individual as father, mother, son, daughter, brother, | 11 | | sister, uncle, aunt, great aunt, great uncle, first cousin, | 12 | | nephew, niece, husband, wife, grandfather, grandmother, | 13 | | grandson, granddaughter, father-in-law, mother-in-law, | 14 | | son-in-law, daughter-in-law, brother-in-law, sister-in-law, | 15 | | stepfather, stepmother, stepson, stepdaughter, stepbrother, | 16 | | stepsister, half brother, or half sister and includes the | 17 | | father, mother, grandfather, or grandmother of the | 18 | | individual's spouse and the individual's fiance or fiancee. | 19 | | (b) Each member of the General Assembly may nominate | 20 | | annually 2 persons of
school age and otherwise eligible, from | 21 | | his district; each shall
receive a
certificate of scholarship | 22 | | in any State supported
university designated by the member. Any | 23 | | member of the General Assembly in
making nominations under this |

| 1 | | Section may designate that his nominee be
granted a 4 year | 2 | | scholarship or may instead designate 2 or 4 nominees for
that | 3 | | particular scholarship, each to receive a 2 year or a one year
| 4 | | scholarship, respectively. A nominee must not be a relative of | 5 | | the member making the nomination. The nominee, if a graduate of | 6 | | a school
accredited by the University to which nominated, shall | 7 | | be admitted to the
university on the same conditions as to | 8 | | educational qualifications as are
other graduates of | 9 | | accredited schools. If the nominee is not a graduate of
a | 10 | | school accredited by the university to which nominated, he | 11 | | must, before
being entitled to the benefits of the scholarship, | 12 | | pass an examination
given by the superintendent of schools of | 13 | | the county where he resides at
the time stated in Section 30-7 | 14 | | for the competitive examination. The
president of each | 15 | | university shall prescribe the rules governing the
examination | 16 | | for scholarship to his university.
| 17 | | (c) A member of the General Assembly may award the | 18 | | scholarship by
competitive examination conducted under like | 19 | | rules as prescribed in Section
30-7 even though one or more of | 20 | | the applicants are graduates of schools
accredited by the | 21 | | university.
| 22 | | (d) This subsection (d) applies until the effective date of | 23 | | this amendatory Act of the 97th General Assembly. A member of | 24 | | the General Assembly may delegate to the Illinois Student
| 25 | | Assistance Commission the authority to nominate persons for | 26 | | General Assembly
scholarships which that member would |

| 1 | | otherwise be entitled to award, or may
direct the Commission to | 2 | | evaluate and make recommendations to the member
concerning | 3 | | candidates for such scholarships. In the event a member
| 4 | | delegates his nominating authority or directs the Commission to | 5 | | evaluate
and make recommendations concerning candidates for | 6 | | General Assembly
scholarships, the member shall inform the | 7 | | Commission in writing of the
criteria which he wishes the | 8 | | Commission to apply in nominating or
recommending candidates. | 9 | | Those criteria may include some or all of the
criteria provided | 10 | | in Section 25 of the Higher Education Student
Assistance Act. A | 11 | | delegation of authority under this subsection (d) paragraph may | 12 | | be revoked
at any time by the member.
| 13 | | (e) This subsection (e) applies beginning on the effective | 14 | | date of this amendatory Act of the 97th General Assembly. Each | 15 | | member of the General Assembly shall delegate to the Illinois | 16 | | Student Assistance Commission the authority to nominate | 17 | | persons for General Assembly scholarships that the member would | 18 | | otherwise be entitled to award. The member shall make | 19 | | recommendations to the Commission concerning candidates for | 20 | | the scholarships. The member may inform the Commission in | 21 | | writing of the criteria that he or she wishes the Commission to | 22 | | apply in nominating candidates. The criteria may include some | 23 | | or all of the criteria provided in Section 25 of the Higher | 24 | | Education Student Assistance Act. | 25 | | (f) Failure of a member of the General Assembly to make a | 26 | | nomination in any
year shall not cause that scholarship to |

| 1 | | lapse, but the member may make a
nomination for such | 2 | | scholarship at any time thereafter before the
expiration of his | 3 | | term, and the person so nominated shall be entitled to
the same | 4 | | benefits as holders of other scholarships provided herein. Any
| 5 | | such scholarship for which a member has made no nomination | 6 | | prior to the
expiration of the term for which he was elected | 7 | | shall lapse upon the
expiration of that term.
