AMENDMENT TO SENATE BILL 3000

2     AMENDMENT NO. ______. Amend Senate Bill 3000 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by adding Section
5 27-1.5 as follows:
 
6     (105 ILCS 5/27-1.5 new)
7     Sec. 27-1.5. Instructional Mandates Task Force.
8     (a) The General Assembly recognizes the increasing number
9 of instructional mandates that it passes each year. The State
10 Board shall create the Instructional Mandates Task Force.
11     (b) The Task Force shall consist of the following voting
12 members:
13         (1) One member appointed by the Governor, who shall
14     serve as chairperson of the Task Force.
15         (2) One member appointed by the President of the
16     Senate.

1         (3) One member appointed by the Minority Leader of the
2     Senate.
3         (4) One member appointed by the Speaker of the House of
4     Representatives.
5         (5) One member appointed by the Minority Leader of the
6     House of Representatives.
7         (6) One member appointed by the State Superintendent of
8     Education.
9         (7) One district superintendent from a rural district
10     appointed by the Governor upon the recommendation of an
11     organization representing school administrators.
12         (8) One district superintendent from a suburban school
13     district appointed by the Governor upon the recommendation
14     of an organization representing school administrators.
15         (9) One district superintendent from a urban school
16     district appointed by the Governor upon the recommendation
17     of an organization representing school administrators.
18         (10) One school principal appointed by the Governor
19     upon the recommendation of an association representing
20     school principals.
21         (11) One member appointed by the Governor upon the
22     recommendation of an association representing special
23     education administrators.
24         (12) One member appointed by the Governor upon the
25     recommendation of an association representing school
26     boards.

1         (13) One member appointed by the Governor upon the
2     recommendation of the Chicago Board of Education.
3         (14) One member appointed by the Governor upon the
4     recommendation of an organization representing teachers.
5         (15) One member appointed by the Governor upon the
6     recommendation of a different organization representing
7     teachers.
8     Members appointed by the legislative leaders shall be
9 appointed for the duration of the Task Force. In the event of a
10 vacancy, the appointment to fill the vacancy shall be made by
11 the legislative leader of the same chamber and party as the
12 leader who made the original appointment.
13     (c) The Task Force shall explore and examine all
14 instructional mandates governing the public schools of this
15 State that currently exist and shall make recommendations
16 concerning, but not limited to, the propriety of all existing
17 mandates, the imposition of future mandates, and waivers of
18 instructional mandates. The Task Force shall ensure that its
19 recommendations include specifics as to the necessary funding
20 to carry out identified responsibilities.
21     (d) The Task Force may begin to conduct business upon the
22 appointment of a majority of the voting members.
23     (e) The State Board of Education shall be responsible for
24 providing staff and administrative support to the Task Force.
25     (f) Members of the Task Force shall receive no compensation
26 for their participation, but may be reimbursed by the State

1 Board of Education for expenses in connection with their
2 participation, including travel, if funds are available.
3     (g) The Task Force shall submit a final report of its
4 findings and recommendations to the Governor and the General
5 Assembly on or before July 1, 2011. The Task Force may submit
6 other reports as it deems appropriate.
7     (h) The Task Force is abolished on July 2, 2011 and this
8 Section is repealed on January 2, 2014.
9     (i) Beginning on the effective date of this amendatory Act
10 of the 96th General Assembly, there shall be a 4-year
11 moratorium on the passage of instructional mandates for public
12 schools unless authorized by a unanimous vote in both the House
13 of Representatives and Senate. For the purposes of this
14 Section, "instructional mandate" means any State law that
15 requires a school district to devote any amount of time to the
16 instruction of or engagement by students in any subject or
17 course.
 
18     Section 99. Effective date. This Act takes effect upon
19 becoming law.".
