AMENDMENT TO SENATE BILL 1920

2     AMENDMENT NO. ______. Amend Senate Bill 1920, AS AMENDED,
3 by replacing everything after the enacting clause with the
4 following:
 
5     "Section 5. The Mobile Home Landlord and Tenant Rights Act
6 is amended by adding Section 8.6 as follows:
 
7     (765 ILCS 745/8.6 new)
8     Sec. 8.6. Mobile and Manufactured Home Relocation
9 Commission.
10     (a) There is created a Mobile and Manufactured Home
11 Relocation Commission. The purpose of the Commission is to
12 study the process and procedure by which a mobile or
13 manufactured home located in a mobile or manufactured home park
14 that is closing is relocated. The Department of Public Health
15 shall provide administrative support to the Commission.
16     (b) The Commission shall consist of the following 10

1 members:
2         (1) the Director of the Department of Public Health or
3     his or her designee;
4         (2) the Attorney General of the State of Illinois or
5     his or her designee;
6         (3) four members of the General Assembly, with the
7     Speaker of the House, the Senate President, the House
8     Minority Leader, and the Senate Minority Leader each making
9     one appointment;
10         (4) the President of an organization primarily
11     representing the interests of park owners having
12     properties in downstate Illinois and mobile and
13     manufactured home retailers or his or her designee,
14     appointed by the Governor;
15         (5) the Executive Director of an organization
16     primarily representing the interests of park owners having
17     properties in northern Illinois or his or her designee,
18     appointed by the Governor; and
19         (6) two representatives of a statewide organization
20     representing the interests of mobile and manufactured home
21     owners, appointed by the Governor.
22     (c) The members appointed by the Speaker of the House and
23 the Senate Minority Leader shall serve as Co-Chairs of the
24 Commission.
25     (d) The Commission shall:
26             (1) examine the implementation and operation of

1         relocation assistance programs in other states;
2             (2) consider possible ways to fund State or local
3         relocation assistance programs, including but not
4         limited to home owner fees, park owner fees, and moving
5         company fees;
6             (3) examine the feasibility of allowing or
7         mandating park owners to create relocation trust
8         funds;
9             (4) examine the feasibility of allowing or
10         mandating a State agency to create a relocation trust
11         fund;
12             (5) explore the potential for greater oversight of
13         park practices;
14             (6) formulate a set of best practices to minimize
15         the impact of park closures on both park owners and
16         home owners;
17             (7) analyze data and other information with
18         respect to relocation;
19             (8) research the availability of insurance
20         policies that cover the costs of relocation; and
21             (9) study the costs and associated legal matters
22         arising from the abandonment of a home in a park.
23     (e) The Commission shall report to the General Assembly on
24 its results and progress on or before January 1, 2010.
25     (f) This Section is repealed on March 1, 2010.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
