AMENDMENT TO SENATE BILL 1559

2     AMENDMENT NO. ______. Amend Senate Bill 1559 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Municipal Code is amended by
5 adding Section 11-40-4 as follows:
 
6     (65 ILCS 5/11-40-4 new)
7     Sec. 11-40-4. American-made vehicles. A municipality shall
8 require that all vehicles purchased or leased on or after the
9 effective date of this amendatory Act of the 96th General
10 Assembly for use by the municipality have a Vehicle
11 Identification Number that begins with the number one, the
12 number 4, or the number 5. A municipality may not regulate the
13 purchase or lease of vehicles in a manner less restrictive than
14 as provided in this Section. This Section is a limitation under
15 subsection (i) of Section 6 of Article VII of the Illinois
16 Constitution on the concurrent exercise by home rule units of

1 powers and functions exercised by the State.
 
2     Section 10. The School Code is amended by adding Sections
3 10-20.46 and 34-18.37 as follows:
 
4     (105 ILCS 5/10-20.46 new)
5     Sec. 10-20.46. American-made driver education vehicles. A
6 school board shall require that all vehicles purchased or
7 leased on or after the effective date of this amendatory Act of
8 the 96th General Assembly that are used for the practice
9 driving part of a driver education course offered by the school
10 district under Section 27-24.2 of this Code have a Vehicle
11 Identification Number that begins with the number one, the
12 number 4, or the number 5.
13     School districts on the financial watch, the financial
14 early warning, or the financial difficulty list, as defined by
15 the State Board of Education, may waive the requirements of
16 this Section for any year following (i) a public hearing and
17 (ii) an affirmative vote of at least two-thirds of the school
18 board members of the district to waive the requirements. Any
19 district waiving the requirements imposed under this Section
20 shall notify the State Board of Education within 45 days after
21 the wavier.

17     Section 90. The State Mandates Act is amended by adding
18 Section 8.33 as follows:
 
19     (30 ILCS 805/8.33 new)
20     Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
21 of this Act, no reimbursement by the State is required for the
22 implementation of any mandate created by this amendatory Act of
23 the 96th General Assembly.".
