1     AN ACT concerning elections.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Election Code is amended by changing
5 Sections 19-3, 20-2, 20-2.1, 20-2.2, 20-2.3, and 20-3 as
6 follows:
 
7     (10 ILCS 5/19-3)  (from Ch. 46, par. 19-3)
8     Sec. 19-3. Application for such ballot shall be made on
9 blanks to be furnished by the election authority and
10 duplication of such application for ballot is prohibited,
11 except by the election authority. The application for ballot
12 shall be substantially in the following form:

15     Sec. 20-2. Any member of the United States Service,
16 otherwise qualified to vote, who expects in the course of his
17 duties to be absent from the county in which he resides on the
18 day of holding any election may make application for an
19 absentee ballot to the election authority having jurisdiction
20 over his precinct of residence on the official postcard or on a
21 form furnished by the election authority as prescribed by
22 Section 20-3 of this Article not less than 10 days before the
23 election. A request pursuant to this Section shall entitle the
24 applicant to an absentee ballot for every election in one
25 calendar year. The original application for ballot shall be

1 kept in the office of the election authority for one year as
2 authorization to send a ballot to the voter for each election
3 to be held within that calendar year. A certified copy of such
4 application for ballot shall be sent each election with the
5 absentee ballot to the election authority's central ballot
6 counting location to be used in lieu of the original
7 application for ballot. No registration shall be required in
8 order to vote pursuant to this Section.
9     Ballots under this Section shall be mailed by the election
10 authority in the manner prescribed by Section 20-5 of this
11 Article and not otherwise. Ballots voted under this Section
12 must be returned postmarked no later than midnight preceding
13 election day and received for counting at the central ballot
14 counting location of the election authority during the period
15 for counting provisional ballots, the last day of which is the
16 14th day following election day. Ballots voted under this
17 Section must be returned to the election authority in
18 sufficient time for delivery to the election authority's
19 central ballot counting location before the closing of the
20 polls on the day of the election.

23     Sec. 20-2.1. Citizens of the United States temporarily
24 residing outside the territorial limits of the United States
25 who are not registered but otherwise qualified to vote and who

1 expect to be absent from their county of residence during the
2 periods of voter registration provided for in Articles 4, 5 or
3 6 of this Code and on the day of holding any election, may make
4 simultaneous application to the election authority having
5 jurisdiction over their precinct of residence for an absentee
6 registration and absentee ballot not less than 30 days before
7 the election. Such application may be made on the official
8 postcard or on a form furnished by the election authority as
9 prescribed by Section 20-3 of this Article. A request pursuant
10 to this Section shall entitle the applicant to an absentee
11 ballot for every election in one calendar year. The original
12 application for ballot shall be kept in the office of the
13 election authority for one year as authorization to send a
14 ballot to the voter for each election to be held within that
15 calendar year. A certified copy of such application for ballot
16 shall be sent each election with the absentee ballot to the
17 election authority's central ballot counting location to be
18 used in lieu of the original application for ballot.
19     Registration shall be required in order to vote pursuant to
20 this Section. However, if the election authority receives one
21 of such applications after 30 days but not less than 10 days
22 before a Federal election, said applicant shall be sent a
23 ballot containing the Federal offices only and registration for
24 that election shall be waived.
25     Ballots under this Section shall be mailed by the election
26 authority in the manner prescribed by Section 20-5 of this

2     Ballots voted under this Section must be returned
3 postmarked no later than midnight preceding election day and
4 received for counting at the central ballot counting location
5 of the election authority during the period for counting
6 provisional ballots, the last day of which is the 14th day
7 following election day.
8     Ballots under this Section must be returned to the election
9 authority in sufficient time for delivery to the election
10 authority's central ballot counting location before the
11 closing of the polls on the day of the election.

14     Sec. 20-2.2. Any non-resident civilian citizen, otherwise
15 qualified to vote, may make application to the election
16 authority having jurisdiction over his precinct of former
17 residence for an absentee ballot containing the Federal offices
18 only not less than 10 days before a Federal election. Such
19 application may be made only on the official postcard. A
20 request pursuant to this Section shall entitle the applicant to
21 an absentee ballot for every election in one calendar year at
22 which Federal offices are filled. The original application for
23 ballot shall be kept in the office of the election authority
24 for one year as authorization to send a ballot to the voter for
25 each election to be held within that calendar year at which

1 Federal offices are filled. A certified copy of such
2 application for ballot shall be sent each election with the
3 absentee ballot to the election authority's central ballot
4 counting location to be used in lieu of the original

7 Section shall be mailed by the election authority in the manner
8 prescribed by Section 20-5 of this Article and not otherwise.

20     Sec. 20-2.3. Members of the Armed Forces. Any member of the
21 United States Armed Forces while on active duty, otherwise
22 qualified to vote, who expects in the course of his or her
23 duties to be absent from the county in which he or she resides
24 on the day of holding any election, in addition to any other
25 method of making application for an absentee ballot under this

1 Article, may make application for an absentee ballot to the
2 election authority having jurisdiction over his or her precinct
3 of residence by a facsimile machine or electronic transmission
4 not less than 10 days before the election.
5     Ballots under this Section shall be mailed by the election
6 authority in the manner prescribed by Section 20-5 of this
7 Article and not otherwise. Ballots voted under this Section
8 must be returned postmarked no later than midnight preceding
9 election day and received for counting at the central ballot
10 counting location of the election authority during the period
11 for counting provisional ballots, the last day of which is the
12 14th day following election day. Ballots voted under this
13 Section must be returned to the election authority before the
14 closing of the polls on the day of election and must be counted
15 at the election authority's central ballot counting location.

18     Sec. 20-3. The election authority shall furnish the
19 following applications for absentee registration or absentee
20 ballot which shall be considered a method of application in
21 lieu of the official postcard.
22     1. Members of the United States Service, citizens of the
23 United States temporarily residing outside the territorial
24 limits of the United States, and certified program participants
25 under the Address Confidentiality for Victims of Domestic

1 Violence Act may make application within the periods prescribed
2 in Sections 20-2 or 20-2.1, as the case may be. Such
3 application shall be substantially in the following form:

"APPLICATION FOR BALLOT
5     To be voted at the............ election in the precinct in
6 which is located my residence at..............., in the
7 city/village/township of ............(insert home address)
8 County of........... and State of Illinois.
9     I state that I am a citizen of the United States; that on
10 (insert date of election) I shall have resided in the State of
11 Illinois and in the election precinct for 30 days; that on the
12 above date I shall be the age of 18 years or above; that I am
13 lawfully entitled to vote in such precinct at that election;
14 that I am (check category 1, 2, or 3 below):
15     1.  ( ) a member of the United States Service,
16     2.  ( ) a citizen of the United States temporarily residing
17 outside the territorial limits of the United States and that I
18 expect to be absent from the said county of my residence on the
19 date of holding such election, and that I will have no
20 opportunity to vote in person on that day.

5 shall destroy said ballot or ballots.
