AMENDMENT TO SENATE BILL 134

2     AMENDMENT NO. ______. Amend Senate Bill 134 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Nursing Home Care Act is amended by
5 changing Section 3-417 as follows:
 
6     (210 ILCS 45/3-417)  (from Ch. 111 1/2, par. 4153-417)
7     Sec. 3-417. Transfer or discharge; alternative placements.
8 The Department shall offer transfer or discharge and relocation
9 assistance to residents transferred or discharged under
10 Sections 3-401 through 3-415, including information on
11 available alternative placements. Residents shall be involved
12 in planning the transfer or discharge and shall choose among
13 the available alternative placements, except that where an
14 emergency makes prior resident involvement impossible the
15 Department may make a temporary placement until a final
16 placement can be arranged. Residents may choose their final

1 alternative placement and shall be given assistance in
2 transferring to such place. No resident may be forced to remain
3 in a temporary or permanent placement. Where the Department
4 makes or participates in making the relocation decision,
5 consideration shall be given to proximity to the resident's
6 relatives and friends. The resident shall be allowed 3 visits
7 to potential alternative placements prior to removal, except
8 where medically contraindicated or where the need for immediate
9 transfer or discharge requires reduction in the number of
10 visits.
11     When the Department provides information on available
12 alternative placements in community-based settings for
13 individuals being discharged or transferred from facilities
14 licensed under this Act, the information must include a
15 comprehensive list of a range of appropriate, client-oriented
16 services and the name of and contact information for the ADA
17 coordinator in the relocation locale. The comprehensive list
18 must include the name and contact information for each agency
19 or organization providing those services and a summary of the
20 services provided by each agency or organization. A hotline or
21 similar crisis telephone number must also be provided to
22 individuals relocating into the community.

24     Section 99. Effective date. This Act takes effect upon
25 becoming law.".
