AMENDMENT TO HOUSE RESOLUTION 66

2     AMENDMENT NO. ___. Amend House Resolution 66 by replacing
3 lines 2 through 20 on page 1 and all of pages 2, 3, and 4 with
4 the following:
5     "WHEREAS, The public has the right to have access to an
6 open and transparent court system; and
 
7     WHEREAS, Some court documents should be protected from
8 disclosure, such as personal financial records and health
9 records; and
 
10     WHEREAS, The Administrative Office of the Illinois Courts
11 has adopted an electronic access policy for circuit court
12 records; and
 
13     WHEREAS, The policy excludes public access in electronic
14 form to complaints, pleadings, and orders, unless the access is
15 provided at the office of the clerk of the court; and

1     WHEREAS, A Task Force should be created to study such
2 exclusion of public access and whether such exclusion is
3 warranted; therefore, be it
 
4     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
5 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
6 public access to court records, while protecting personal
7 records of individuals, is in the public interest; and be it
8 further
 
9     RESOLVED, That the Task Force on Electronic Access to
10 Circuit Court Records (hereinafter referred to as the Task
11 Force) is created; and be it further
 
12     RESOLVED, That the Task Force shall consist of 12 members
13 appointed as follows:
14         (1) one member appointed by the Speaker of the House of
15     Representatives;
16         (2) one member appointed by the Minority Leader of the
17     House of Representatives;
18         (3) two members appointed by the Director of the
19     Administrative Office of the Illinois Courts;
20         (4) one member appointed by the Speaker of the House of
21     Representatives from a Statewide bar association;
22         (5) one member appointed by the Minority Leader of the

1     House of Representatives from a Statewide bar association;
2         (6) one member appointed by the Speaker of the House of
3     Representatives from a consumer protection group;
4         (7) one member appointed by the Minority Leader of the
5     House of Representatives from a consumer protection group;
6         (8) one member appointed by the Speaker of the House of
7     Representatives from a group representing members of the
8     free press;
9         (9) one member appointed by the Minority Leader of the
10     House of Representatives from a group representing members
11     of the free press; and
12         (10) two members appointed by a group representing
13     court clerks who represent different technologies
14     currently in use by the individual counties throughout
15     Illinois; and be it further
 
16     RESOLVED, That the Task Force shall choose its chairperson
17 and such other officers as it deems necessary, and seek the
18 assistance of such experts as it deems necessary; and be it
19 further
 
20     RESOLVED, That the members of the Task Force shall receive
21 no compensation as members of the Task Force but may be
22 reimbursed for actual expenses incurred by the members in
23 performance of their duties as members of the Task Force from
24 funds appropriated to the Administrative Office of the Illinois

1 Courts for that purpose; and be it further
 
2     RESOLVED, That the Task Force shall study laws and
3 procedures relating to electronic access by the public to
4 circuit court records and the exemptions from such disclosure;
5 and be it further
 
6     RESOLVED, That the Task Force shall make its
7 recommendations concerning electronic access to circuit court
8 records and shall submit a report of its findings to the
9 Governor and the General Assembly by May 31, 2010; and be it
10 further
 
11     RESOLVED, That upon submission of its report to the
12 Governor and the General Assembly, the Task Force shall be
13 dissolved.".
