AMENDMENT TO HOUSE JOINT RESOLUTION 18

2     AMENDMENT NO. ___. Amend House Joint Resolution 18, AS
3 AMENDED, by replacing everything after "AMENDMENT TO HOUSE
4 JOINT RESOLUTION 18" with the following:
 
5     "WHEREAS, On January 1, 2009, Public Act 95-773, known as
6 the Cindy Bischof Law, took effect; and
 
7     WHEREAS, The Law requires that when a person is charged
8 with a violation of an order of protection, the court shall
9 order the respondent to undergo a risk assessment and based on
10 the results of the risk assessment and the other circumstances
11 of the violation, it permits the court to order that the
12 person, as a condition of bail, be placed under electronic
13 surveillance and it permits the court to order an offender who
14 is sentenced to probation or conditional discharge for a
15 violation of an order of protection to be placed under
16 electronic surveillance; and the Law requires that, as a

1 condition of parole or mandatory supervised release, a person
2 convicted of a violation of an order of protection must be
3 placed under electronic surveillance; and
 
4     WHEREAS, The Law requires the supervising authority to use
5 the best available global positioning technology to track
6 domestic violence offenders; and
 
7     WHEREAS, The General Assembly finds that a Task Force to
8 facilitate the implementation of the Cindy Bischof Law is
9 necessary; therefore, be it
 
10     RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
11 NINETY-SIXTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
12 SENATE CONCURRING HEREIN, that the Cindy Bischof Law
13 Implementation Task Force is created within the Illinois
14 Department of Corrections; and be it further
 
15     RESOLVED, That the Task Force shall consist of 22 members
16 appointed as follows:
17         (1) 2 members appointed by the President of the Senate
18     of which one member shall be a Senator and one shall be a
19     member of the public;    
20         (2) 2 members appointed by the Minority Leader of the
21     Senate of which one member shall be a Senator and one shall
22     be a member of the public;

1         (3) 2 members appointed by the Speaker of the House of
2     Representatives of which one member shall be a
3     Representative and one shall be a member of the public;
4         (4) 2 members appointed by the Minority Leader of the
5     House of Representatives of which one member shall be a
6     Representative and one shall be a member of the public;
7         (5) one member representing the Illinois Attorney
8     General appointed by the Attorney General;
9         (6) one member representing the Administrative Office
10     of the Illinois Courts appointed by the Director of the
11     Administrative Office of the Illinois Courts;
12         (7) one member representing the Office of the Governor
13     appointed by the Governor;
14         (8) one member representing the Illinois Family
15     Violence Coordinating Council appointed by that Council;
16         (9) one member representing the Illinois Department of
17     Human Services, Bureau of Domestic & Sexual Violence
18     Prevention appointed by the Secretary of Human Services;
19         (10) one member representing the Illinois Department
20     of Corrections-Parole Division appointed by the Director
21     of Corrections;
22         (11) one member representing the Illinois State's
23     Attorneys Association appointed by that Association;
24         (12) one member representing the Illinois Association
25     of Chiefs of Police appointed by that Association;
26         (13) one member representing the Illinois Sheriffs'

1     Association appointed by that Association;
2         (14) one member representing the Chicago Metropolitan
3     Battered Women's Network appointed by that Network;
4         (15) one member representing the Illinois Coalition
5     Against Domestic Violence appointed by that Coalition;
6         (16) one member representing the Office of the Cook
7     County State's Attorney appointed by the Cook County
8     State's Attorney;
9         (17) one member representing the Illinois Probation
10     and Court Services Departments appointed by the Director of
11     the Administrative Office of the Illinois Courts; and
12         (18) one member representing the Cook County Adult
13     Probation Services Department appointed by the chief
14     probation officer of Cook County; and be it further
 
15     RESOLVED, That the Task Force shall choose its chairperson
16 and such other officers as it deems necessary; and be it
17 further
 
18     RESOLVED, That the Task Force shall facilitate the
19 implementation of the Cindy Bischof Law and study the progress
20 of implementation of the Cindy Bischof Law; and be it further
 
21     RESOLVED, That the members of the Task Force shall receive
22 no compensation as members of the Task Force but may be
23 reimbursed for actual expenses incurred by the members in

1 performance of their duties as members of the Task Force from
2 appropriations made for such purpose; and be it further
 
3     RESOLVED, That the Task Force shall make its
4 recommendations on the progress of implementation of the Cindy
5 Bischof Law and shall submit a report of its findings to the
6 Governor and the General Assembly by September 1, 2009 and
7 shall make quarterly reports to the Governor and the General
8 Assembly thereafter.".
