Amends the Illinois Historic Preservation Act and the State Finance Act. Provides that the Illinois Historic Sites Fund and the Presidential Library and Museum Operating Fund are not subject to sweeps, administrative charges, or charge-backs or any other fiscal or budgetary maneuver that would in any way transfer any amounts from those Funds into any other fund of the State. Effective immediately.

| AN ACT concerning finance.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Historic Preservation Act is | 5 |
| amended by changing Section 15 as follows:
| 6 |
| (20 ILCS 3410/15) (from Ch. 127, par. 133d15)

| Sec. 15.
All monies received for historic preservation | 8 |
| programs administered
by the Agency, including grants, direct | 9 |
| and indirect cost reimbursements,
income from marketing | 10 |
| activities, gifts, donations and bequests, from
private | 11 |
| organizations, individuals,
other State agencies or federal | 12 |
| agencies, monies received from publications,
and copying and | 13 |
| certification fees related to such programs, and all income
| 14 |
| from fees generated from admissions, special events, parking, | 15 |
| camping,
concession and property rental, shall be deposited | 16 |
| into a special fund in the
State treasury, to be known as the | 17 |
| Illinois Historic Sites Fund, which is
hereby created. Subject | 18 |
| to appropriation, the monies in such fund shall be
used by the | 19 |
| Agency for historic preservation purposes only.

| The Illinois Historic Sites Fund is not subject to sweeps, | 21 |
| administrative charges, or charge-backs, including but not | 22 |
| limited to those authorized under Section 8h of the State | 23 |
| Finance Act, or any other fiscal or budgetary maneuver that |

| would in any way transfer any funds from the Illinois Historic | 2 |

| Section 10. The State Finance Act is amended by changing | 5 |
| Section 6z-57 as follows:

| Sec. 6z-57. The Presidential Library and Museum Operating | 8 |
| Fund.
| 9 |
| (a) There is created in the State treasury a special fund | 10 |
| to be known as
the Presidential Library and Museum Operating | 11 |
| Fund.
All moneys received by the Abraham Lincoln Presidential | 12 |
| Library and Museum from
admission fees, retail sales, and | 13 |
| registration fees from conferences and other
educational | 14 |
| programs shall be deposited into the Fund.
In addition, money | 15 |
| shall be deposited into the Fund as provided by law.
| 16 |
| (b) Money in the Fund may be used, subject to | 17 |
| appropriation, for the
operational support of the Abraham | 18 |
| Lincoln Presidential Library and Museum and
for programs | 19 |
| related to the Presidential Library and Museum at public
| 20 |
| institutions of higher education.
| 21 |
| (c) The Presidential Library and Museum Operating Fund is | 22 |
| not subject to sweeps, administrative charges, or | 23 |
| charge-backs, including but not limited to those authorized | 24 |
| under Section 8h of the State Finance Act, or any other fiscal |

| Section 99. Effective date. This Act takes effect upon | 6 |
| becoming law.
